چالش‌های فقهی و حقوقی پیوند بیضه و تخمدان و آثار مترتب بر آن

درمان ناباروری مساله‌ای است که موجب بازشدن دریچه‌های جدیدی در علوم پزشکی و غیر پزشکی شده است. از آنجا که روش‌های مرسوم درمان ناباروری، مانند لقاح داخل‌ رحمی، لقاح خارج‌ رحمی، اهدای جنین، اهدای گامت‌ و رحم جایگزین و... از دیدگاه فقها دارای برخی اشکالاتی است، به نظر می‌رسد باید برای ادامه کار درمان ناباروری، به راه‌کارهای دیگری اندیشید. سیر پیشرفت در حوزه علوم پزشکی و مسائل مبتلا به آن در حوزه فقه، چنان است که باید روش‌های جدید و ابداعات درمانی را مورد نقد و بررسی قرار داد تا بتوان راه‌کارهای علمی مبتنی بر رعایت اصول و قواعد فقهی برای آن پیدا کرد. از دیدگاه فقهی و حقوقی موضوع پیوند دستگاه‌های مولد تولید مثل با توجه به نقش آن در درمان ناباروری، درخور نگاه جدی است. این روش درمانی از نظر تجربی در مراکز پزشکی حتی در غرب، مراحل مقدماتی خود را در حال گذراندن است. اهمیت توجه به این موضوع، از آن رو است که حفظ نسل برای انسان‌های نابارور و نیز بهبود و سلامت زندگی آنان، دستاوردی است که پیوند بیضه و تخمدان می‌تواند برای این‌گونه افراد داشته باشد، زیرا ناباروری در موارد بسیاری سبب ایجاد صدمات شدید روحی و روانی برای زوجه، زوج یا هر دو می‌شود و چه بسا گاهی منجر به طلاق که خود یک آسیب بزرگ اجتماعی و مکروه‌ترین حلال شرع مقدس است می‌شود. ضرورت انجام پیوند بیضه و تخمدان، بررسی و تبیین مبانی فقهی و حقوقی جواز و عدم جواز و آثار و دستاورد این نوع پیوند برای زوجین، برخورداری از بیضه و تخمدان پیوندی به منزله عضو اصلی بدن، در نتیجه منجر می‌شود فرزند تولدیافته، فرزند مشروع محسوب شود و بر اساس آن، تمام حقوق و تکالیف شرعی و قانونی پدر و مادر نسبت به فرزند و فرزند نسبت به والدین، مانند نسب کودک، صحت وصیت برای این نوع حمل، مسوولیت والدین در برابر اعمال و رفتار ضمان‌آور فرزندان و برخورداری فرزندان از منافع، نفقه، نام خانوادگی، حق اقامتگاه، حق تابعیت و... رخ بنماید.
