اعتبار نظر پزشک متخصص در سقوط یا تبدیل مجازات محارب و مفسد فی الارض دارای اختلالات روحی روانی

محاربه و افساد فی الارض از جمله جرائم امنیتی است که در قانون مجازات اسلامی مصوب 1392 که از یکدیگر تفکیک شده و هر یک مصادیق مختص به خود را دارا می‌باشند، اما آنچه که در این بین مهم است، آن است که برخی از مرتکبین این جرائم از نظر روانی و پزشکی، توان تحمل کیفر را ندارند، لذا باید دید آیا با توجه به اهمیت و شدت این دو جرم، ناتوانی‌های روحی، روانی و پزشکی می‌تواند به عنوان عوامل مُسقِط کیفر مطرح گردند؟ این پرسش اساسی زمینه انجام پژوهش مستقل را فراهم می‌نماید. مشهور فقها برخی بیماری‌های روانی از جمله جنون را مسقط کیفر نمی‌دانند، لکن به نظر می‌رسد ادله مشهور در این زمینه ناکافی است و با برخی از ادله دیگر در تعارض می‌باشد. قانون مجازات اسلامی و آیین دادرسی کیفری نیز علی‌رغم نوآوری در عین حال دارای نارسایی‌های می‌باشد. بنابراین فرضیه پژوهش آن است که مشکلات روحی روانی، از جمله جنون که به تایید پزشکان متخصص برسد، می‌تواند عامل سقوط و یا تبدیل کیفر مرتکبین جرائم محاربه و افساد فی الارض قرار گیرد. روش پژوهش توصیفی تحلیلی با استفاده از منابع کتابخانه‌ای می‌باشد.

Validity of the Opinion of a Physician Specializing in the fall or Conversion of the Punishment of a Warlord and Corruptor on Earth with Mental Disorders

Warlord and corruption on earth are among the security crimes in the Islamic Penal Code adopted in 1392, which are separated from each other and each has its own instances. But what is important in the meantime is that some perpetrators of these crimes are not psychologically and medically able to bear the punishment, so it remains to be seen whether, given the importance and severity of these two crimes, mental, psychological and medical disabilities can to be considered as just agents of punishment? This fundamental question provides the basis for independent research. Wellknown jurists do not consider Muscat as a punishment for some mental illnesses such as insanity. However, the wellknown arguments in this regard seem to be insufficient and are in conflict with some other arguments. Despite the innovation, the Islamic Penal Code and the Code of Criminal Procedure also have shortcomings. Therefore, the research hypothesis is that psychological problems, including insanity, which are confirmed by specialized doctors, can be the cause of the fall or conversion of the perpetrators of warlords and corruption on earth.
