بررسی قوانین حاکم بر معاملات دارو و کالاهای پزشکی مبتنی بر حقوق تجارت بین‌الملل در هنگامه شیوع بیماری مسری فرامرزی

به ‌طور بنیادین، صنعت داروسازی و فرایند توزیع آن از جمله موضوعاتی است که برای هر جامعه قابل‌طرح است، زیرا در صورت فقدان ملزومات تضمین سلامت از حیث دارو و دیگر اقلام کالاهای مرتبط با صنایع پزشکی، تهدیدات متنوعی می‌تواند از انسان سلب حیات نماید، در صورتی ‌که آنچه از عرف، اخلاق، شرع و جامعه‌شناسی برای انسان به ارمغان آمده است، حفظ حیات در زمره با اولویت‌ترین دارایی فردی و اجتماعی وی است. به همین منظور مقوله دارو و تجهیزات پزشکی که ارتباط تنگاتنگی با حق حیات و سلامت بشریت دارد، می‌تواند فاکتور بسیار مهمی در این زمینه باشد، لذا در این پژوهش که به شیوه تحلیلی توصیفی به رشته تحریر درآمده است، هدف بررسی و نگاهی ژرف بر مقوله معاملات و قواعد تجاری و حقوقی موجود در حوزه دارو و دیگر کالاهای پزشکی را از منظر حقوق بین‌الملل تجارت می‌باشد. یافته‌ها حاکی از آن است که به طور مشخص و مختصر سازوکار حقوق تجارت بین‌الملل در قالب عمده‌ترین اقدامات قابل انجام در این زمینه می‌تواند مساله مالکیت فکری را بعد از حق سلامت در کالبد حقوق بشری ابقا نموده، همچنین با استفاده از ظرفیت‌های قانونی بتواند تحریم‌های دارویی را کم‌رنگ نماید، عدم تبعیض قائل‌شدن در زمان عقود و قراردادها بین کشورهای مختلف از سوی تولیدکنندگان، تعهدات قانونی و تضمینات حقوق دال بر عدم کاسته‌شدن از کیفیت داروها و اقلام پزشکی در بحبوحه بحران سلامت به منظور ارتقای سود شرکت‌های تولیدکننده دارو، آسان‌سازی رویه معاملات و خرید و فروش دارو و تجهیزات پزشکی و برقراری امکاناتی ویژه جهت دسترسی کشورهای فقیر به دارو و مایحتاج پزشکی و دیگر مسائلی از این قبیل، نقش حقوق تجارت بین‌الملل را از رهگذر نیاز کشورها به دارو در پی شیوع بیماری‌های مسری فرامرزی همچون کرونا ویروس، پررنگ، برجسته و ممتاز متجلی بنماید.

Examining the Rules Governing Drug and Medical Goods Transactions Based on International Trade Law in the Event tf the Outbreak of Cross-Border Infectious Disease

Basically, the pharmaceutical industry and its distribution process are among the topics that are relevant to any society. Because if there is no need to ensure health in terms of medicine and other items of goods related to the medical industry, various threats can deprive a person of life. Whereas what has been brought to man by custom, morality, sharia and sociology, the preservation of life is one of his most important personal and social assets. For this reason, the category of medicine and medical equipment, which is closely related to the right to life and human health, can be a very important factor in this regard. Therefore, in this research, which has been written in an analyticaldescriptive manner, the aim is to examine and look in depth at the category of transactions and commercial and legal rules in the field of medicine and other medical goods from the perspective of international trade law. In a nutshell, the international trade law mechanism, in the form of the most important measures that can be taken in this regard, can also use the issue of ownership and, using legal capacity, to maintain the mindset after the right to health in human rights law, reduce drug sanctions, discrimination. Being at the time of contracts and agreements between different countries by you Leaders, legal obligations and rights guarantees to reduce the quality of medicines and medical items in the midst of a health crisis in order to improve the profits of pharmaceutical companies, facilitate the process of trading and buying and selling medicines and medical equipment and special facilities for poor countries to access medicine and supplies.
