مطالعه تطبیقی ابعاد حقوقی انجماد انسان در حقوق ایران و آمریکا

انجماد انسان یا کرایونیک یکی از مسائل نوپدید در علم پزشکی محسوب می‌گردد که نخستین‌بار در سال 1960 مطرح شد. در این روش با قراردادن دمای بدن انسان در منفی 196 درجه اقدام به حفاظت از بدن می‌شود تا در آینده با پیشرفت علم پزشکی، اقدام به احیای اشخاص منجمد گردد. این روش امیدی برای حیات دوباره بیماران لاعلاج ایجاد کرده است. علی‌رغم سکوت قوانین موضوعه، موسسات مختلفی در چند کشور به ویژه در آمریکا، روسیه و استرالیا اقدام به انجماد انسان‌ها می‌نمایند. موسسه آﻟﮑﻮر در آمریکا از ﺷﻨﺎﺧﺘﻪ‌ﺷﺪه‌ﺗﺮیﻦ موسسات ﻣﯽ‌ﺑﺎﺷﺪ. در رویه قضایی برخی نظام‌های حقوقی مانند انگلیس و آمریکا نیز نشانه‌هایی از توجه به این موضوع ملاحظه می‌شود. مساله اصلی در خصوص انجماد انسان، وضعیت حقوقی اشخاص منجمدشده از حیث زنده یا مرده‌بودن است. تبیین آثار حقوقی انجماد انسان، مستلزم تشخیص وضعیت حیات اشخاص منجمد شده است. در این مقاله بر مبنای اثبات زنده‌محسوب‌گردیدن اشخاص منجمد، مهم‌ترین آثار حقوقی انجماد انسان از جمله وضعیت رابطه زوجیت شخص منجمد و وضعیت اموال و قراردادهای جاری او مورد مطالعه و ارزیابی قرار گرفته است. با توجه به عدم شناسایی این مفهوم در حقوق ایران، برای معرفی و تبیین آثار آن ناگزیر از استفاده از تجارب کشورهایی هستیم که در عمل از این نهاد استفاده می‌کنند. در این مقاله به روش توصیفی تحلیلی و با توجه به حقوق آمریکا به لحاظ پیشگام‌بودن در این عرصه، مفهوم انجماد و برخی آثار حقوقی آن تبیین شده است.

Comparative Study of Legal Aspects of Cryonics in Iran and US Law

Cryonics is one of the emerging issues in medical science, which was first introduced in the 1960. In this way, by placing the human body temperature at a negative 196 degrees, the body is protected and with the advancement of medical science in the future, it will attempt to revive it. This method has created hope for life for the sick. Despite the silence of the laws in this regard, various institutions in several countries, especially in the United States, Russia and Australia, have begun to freeze human beings. The Alcor Institute in America is one of the most recognized institutions. There are also signs of attention to this issue in the precedent of some legal systems such as the United Kingdom and the United States. The main issue regarding cryonics is the legal status of frozen persons from the perspective of life or death. In this article, with the assumption of the live of frozen individuals, the most important legal effects of cryonics, including the status of the marriage, property and current contracts, have been studied. Given the lack of recognition of this concept in Iranian law, in order to introduce and explain its effects we have to use the experiences of the countries that use it practically. In this article cryonics and some legal effects of it is studied with descriptiveanalytic method and with regard to American law as a pioneer in this field.Please cite this article as: Safari N, Bouzari S.
