آثار اخلاقی پذیرش خودکشی مساعدت‌شده در حقوق ایران

زمینه و هدف: امروزه موضوع آتانازی و یکی از انواع آن، یعنی خودکشی مساعدت‌شده، جنجال‌های زیادی در محافل حقوقی جهان ایجاد کرده است. خودکشی مساعدت‌شده به عنوان شیوه‌ای برای پایان‌دادن به حیات طبیعی بیماران لاعلاج مورد استفاده قرار می‌گیرد. این مقاله با رویکردی پیامدگرا درصدد تحلیل آثار اخلاقی خودکشی مساعدت‌شده در فرض پذیرش آن در حقوق ایران است. روش‌: مقاله حاضر با بهره‌گیری از روش توصیفی تحلیلی و با تکیه بر منابع اسنادی و کتابخانه‌ای، موضوع خودکشی مساعدت‌شده را از منظر اخلاقی و مخصوصاً از دیدگاه قرآن کریم، روایات و اسلام‌شناسان مورد توجه قرار داده است. یافته‌ها: مهم‌ترین یافته‌های پژوهش حاضر، عدم همخوانی خودکشی مساعدت‌شده از منظر اخلاق اسلامی با خودکشی مساعدت‌شده در غرب است. همچنین نقض آشکار قواعد شرعی و حقوق اجتماعی بیماران و سالمندان از مهم‌ترین آثار پذیرش خودکشی مساعدت‌شده است.بحث و نتیجه‌گیری: پذیرش خودکشی مساعدت‌شده می‌تواند مسوولیت‌گریزی جامعه پزشکی و رواج بی‌اعتمادی در جامعه را دامن بزند. همچنین نگاه فرصت‌گرایانه حقوق اسلامی نسبت به بیماران جای خود را به نگاه تهدیدآمیز می‌دهد که به جای نگهداری از بیماران لاعلاج در قالب‌های مختلفی در جامعه رها می‌شوند و و همچنین قبح خودکشی را نیز از بین می‌برد.

Ethical Effects of the Reception of Assisted Suicide in Iranian Law

Background and aim: Today, the topic of Euthanasia and one of its variants, it means assisted suicide, has caused a lot of controversy in the legal circles of the world. Assisted suicide is used as a way to end the natural life of incurable patients. This article seeks to investigate the ethical effects of assisted suicide by a consequentialist approach in Iranian law.Method: This article that using a descriptiveanalytical approach and relying on documentary and library sources, has focused on the issue of assisted suicide from the moral point of view and especially from the viewpoint of the Holy Qurchr('39')an, traditions and Islamists.Results: The most important findings of the present study are the disagreement of assisted suicide From Islamic perspective and assisted suicide in the West. One of the most important effects of assisted suicide acceptance is a clear violation of religious rules and social rights of patients and olds.Conclusion: Acceptance of assisted suicide can promote nonresponsibility between medical community and the prevalence the mistrust in the community. Also the opportunistic view of Islamic law towards patients also takes its place to a threatening one, that Instead of caring of uncured patients, they are released into various forms of society and also it destroys suicide ugly.Please cite this article as: Lashgari S, Asadi H.
