ترمیم بکارت: مصلحت یا مفسده

هایمنوپلاستی (hymenoplasty) یا ترمیم پرده بکارت عملی است که پزشکان به منظور ترمیم پرده بکارت دختری که آن را در اثر داشتن ارتباط جنسی کافی (منظور مقاربت مهبلی است) با فرد دیگری یا در اثر حوادث دیگر از دست داده است، انجام می‌دهند.پزشکان در طول طبابت خود ممکن است با تقاضاهایی رو به ‌رو شوند که جنبه درمانی ندارد و برخاسته از ملاحظات فرهنگی و عرفی جامعه است. با توجه به این‌که پزشک در چنین مواردی نیز باید بیشترین منفعت را برای بیمار در نظر بگیرد و از طرفی نمی‌تواند ملاحظات فرهنگی و عرفی جامعه را نادیده گیرد، با چالش مواجه می‌شود. یکی از این موارد چالش‌برانگیز ترمیم پرده بکارت (hymen) است (1).هدف از انجام چنین عملی باکره نشان‌دادن زن و گاه فریب شوهر در ازدواج است، اما این‌که آیا انجام چنین عملی جایز است یا خیر امری است که از منظر فقهی و حقوقی در این مقاله به آن پاسخ داده خواهد شد.

Hymenoplasty: Benefit or Corruption

Hymenoplasty is a surgery that doctors perform to repair girl `s virginity who lost it through virginal intercourse or other accidents. During their practice, doctors may face demands that do not have a therapeutic effect and are derived from the cultural and customary considerations of society. Given the fact that the doctor should also consider the patient's greatest benefit in such cases and, on the other hand, cannot ignore the cultural and customary considerations of the community, so it is challenging. One of those challenging issues is the hymnal patch repair (Hayman).The aim of this operation is to show a woman has still virginity or to deceive her husband.
