مبانی مسوولیت پزشک در فقه و حقوق ایران تحلیل ماده 495 قانون مجازات اسلامی

ماده 495 قانون مجازات اسلامی را می توان ارمغان تنظیم نوین حقوقی برای جامعه پزشکی دانست. گذر از مسوولیت مطلق پزشک و ورود به ضمان او با فاکتورهای قصور و تقصیر، ماده 495 قانون مجازات اسلامی به نوعی تقدیر از خدمات صادقانه و متعهدانه پزشک تلقی می شود و در عمل راه اقدامات جسورانه را توسط پزشک، که همواره با حیات انسان ها گره خورده، باز می کند. در ماده 495 قانون مجازات اسلامی اصل بر معالجه متعهدانه و متخصصانه پزشک قرار داده شده و در فرازی دیگر، اخذ برائت از بیمار یا اولیای وی، عدم تقصیر پزشک، رعایت موازین فنی و مقررات پزشکی و... شرط شده است. این مقاله در پی آن است که با واکاوی حقوقی این ماده و تعارضی که محتمل است در تبصره 1 ماده 496 همان قانون داشته باشد، اثبات کند که این ماده کامل نبوده و به اصلاحات ضروری نیاز دارد.
