کارنامه هیات عمومی دیوان عدالت اداری از 1388 تا 1394 در ترازوی حقوق شهروندی (حقوق مدنی و سیاسی)

نهادهای اداری به دلیل بهره مندی از صلاحیت و اختیارات گسترده، به سادگی می توانند با وضع مقررات گوناگون، حقوق شهروندی را نقض نمایند. بدین لحاظ و به دلیل دیگر، من جمله نظام کنترل قضایی و در ایران، دیوان عدالت اداری برای مهار قدرت اداره پایه گذاری شده است. از مهم ترین ارکان دیوان، هیات عمومی است که سه خروجی دارد: آرای ابطالی، وحدت و ایجاد رویه. در این نوشتار، رویه هیات عمومی دیوان از 1388تا 1394 بررسی شده و رای های صادره در مقام حمایت از حق ها و آزادی ها استخراج و تحلیل شده اند، لذا این پژوهش در مورد آرای ایجابی هیات عمومی است و منظور از آن، مواردی است که هیات عمومی با تکیه بر صلاحیت خود، ورود کرده و حقوق شهروندی را حراست نموده است. از این رو مساله پژوهش، این بوده که در سال های مذکور، حق های مدنی و سیاسی شهروندان با چه کیفیتی در هیات عمومی دیوان، تضمین شده است؟ نتیجه اما حکایت دارد که از مجموع آرای مورد مطالعه، 21 رای مربوط به حقوق مدنی است که به نحو آشکاری، اندک می نماید. بیشترین رای نیز در خصوص مراعات برابری است که نشان می دهد پس از گذشت قریب به 40 سال از پیروزی انقلاب اسلامی، تساوی و منع تبعیض منفی، همچنان مساله اول مردم، دیوان و حتی حکومت است.

Jurisprudence of the Court of Administrative Justice Judges Council from 2009 to 2015 in the Light of Citizenship Rights(civil and political rights)

Administrative bodies can simply be regulated by the rules and regulation, because of their extensive jurisdiction and authority, various violations of citizenship rights. One of the most important elements of the Administrative Justice Court is the Justice Judges Council, which has three outlets. In this paper, the Jurisprudence of the Administrative Justice Court have been investigated from 2009 to 2015 have been extracted and analyzed in support of rights and freedoms. So this research is about the cases in which, protecting human rights or citizenship. Hence, the research problem was that in the years to what extent have civil and political rights been respected in the area of citizenship? The result is, there are 21 cases about civil rights makes The most Justice Judgment are about equal treatment, which shows that after nearly 40 years, the year of the victory of the Islamic Revolution, the equalization and the prohibition of negative discrimination, remains the first issue of the people, the Administrative Justice Court and even the government.Please cite this article as: Agah V, Nabi Boorboori M.
