نقش پیوند عضو در حق قصاص

در جایی که مجنی علیه با استفاده از امکانات پزشکی عضو قطع شده را به بدن خود پیوند زند و از نظر قانونی و شرعی این حق را برای وی به رسمیت بشناسیم، این سوال مطرح است که آیا حق قصاص وی ساقط می گردد یا خیر؟در پاسخ به سوال یادشده، هرچند دیدگاه های متعددی مطرح است، به نظر می رسد با وقوع جنایت حق قصاص برای مجنی علیه ایجاد می شود و استفاده یا عدم استفاده وی از پیوند عضو، تاثیری در این حق ندارد و استناد به مماثلت در بقای اثر جنایت تا زمان قصاص یا مقایسه ترمیم عضو به ترمیم دندان و سقوط حق قصاص، قابل قبول نیست.

The Efect of Organ Transplantation on the Right of Retribution

Where a victim with the use of medical treatments reattaches the cutoff organ to his/her body, supposing that we recognize his or her rights in terms of legal and legitimate rights in the mentionedmatter, this raises a critical question that is whether his/her right of retribution still remains?In response to this question, despite of the current, divergent views, it seems that by the occurrence of felony, the right of retribution for the victim is established and the use or nonuse of organ reattachment has no effects on this right. Furthermore, this article concludes arguing that the effect of felony should remain to time of retribution and comparing the organ reattachment to tooth restoration, which causes deterioration of retribution rights, is not acceptable.Please cite this article as: Aghababaei Beni I.
