تعهدات ناشی از قرارداد درمان با تاکید بر طرح چارچوب مشترک مرجع (Dcfr)

قرارداد درمان از عقودی است که برای هر یک از طرفین آن، یعنی بیمار و پزشک (یا مرکز درمانی) تعهدات متقابلی را در پی دارد؛ تعیین دقیق حدود و ثغور این تعهدات در اجرای بهتر عقد درمان و به ویژه تضمین حقوق بیمار نقش به سزایی دارد. امری که قانونگذار ایران کم تر به آن پرداخته و صرفاً در بعضی قوانین و آیین نامه ها به طور پراکنده برخی از تعهدات پزشک را بیان کرده است. حال آنکه این موضوع مورد توجه قانونگذاران تعدادی از کشورهای اروپایی از جمله هلند و آلمان قرار گرفته و بخشی از قانون مدنی خود را به مقررات خاص عقد درمان اختصاص داده اند. در سند طرح چارچوب مشترک مرجع نیز که طرح قانون مدنی آینده اروپا محسوب می شود، مقررات عقد درمان در بخش مربوط به عقود معین گنجانده شده است. در این مقاله به بررسی تعهدات متقابل طرفین عقد درمان در سند مذکور و حقوق برخی کشورهای اروپایی و همچنین حقوق ایران پرداخته شده است.

Obligations Arising from Treatment Contract with Emphasis on Draft Common Frame of Reference (DCFR)

A treatment contract involves joint obligations for the contracting parties which are normally a patient, a physician or a health center. A precise and detailed determination of the scope of these obligations plays a crucial part in the performance of the contract and specially in securing patients rsquo; rights. This is what the Iranian legislator has failed to address or better to say that only in some separated regulations there have been a set out of rules in regards to some obligations of physicians. On the other hand, the laws of some countries such as the Netherlands and Germany have devoted specific parts of their civil code to deal with treatment contracts. The Draft Common Frame of Reference (henceforth: the DCFR), which amounts to a draft of European prospective Civil Code, has also allocated specific provisions regarding treatment contracts in section addressing specific contract . This study examines parties rsquo; joint obligations in a treatment contract from the perspective of the DCFR, some European countries, and Iranian law.Please cite this article as: Shoarian E, Ebadzadeh H.
