مفهوم عدالت زیست‌ محیطی و انعکاس آن در اسناد منطقه‌ای و بین‌المللی

اعلامیه جهانی حقوق بشر با تاکید بر عدم تبعیض و حق دسترسی به غذا برای آحاد مردم، تدوین ‌شده است. پیشرفت تمدن، به‌خصوص بعد از انقلاب صنعتی موجب تخریب گسترده محیط‌ زیست شده است. تلاش بشر برای محافظت از محیط‌زیست از اواخر قرن بیستم شدت یافت، اما اغلب این فعالیت‌ها بر جلوگیری از تخریب محیط‌زیست تمرکز داشته است و بر آثار تخریب محیط‌زیست بر انسان‌ها توجهی نکرده است. به‌طورکلی در حقوق بین‌الملل، سازوکاری برای جلوگیری یا جبران خسارت برای انسان‌هایی که قربانی تخریب محیط‌زیست می‌شوند، پیش‌بینی نشده است. مفهوم عدالت زیست‌محیطی از مقوله‌های جدید حقوق بین‌الملل است و بدین منظور ابتدا به بحث درباره عدالت زیست ‌محیطی و محیط ‌زیست‌گرایی می‌پردازیم تا تفاوت آنها را مشخص کنیم و سپس جنبه‌های عدالت زیست‌محیطی در اسناد منطقه‌ای و بین‌المللی را مورد بررسی قرار می‌دهیم تا ضرورت ایجاد یک نظام حقوقی ناظر بر عدالت زیست‌محیطی را نشان دهیم.

The Concept of Environmental Justice and Its Reflection on Regional and International Documents

The Universal Declaration of Human Rights, has been collected with an emphasis on nondiscrimination between people and the right to food for all. The progress of civilization, especially after the Industrial Revolution led to the destruction of the environment. Human efforts to protect the environment were intensified in the late twentieth century but most of this activity has focused on the prevention of environmental degradation and has ignored the effects of environmental degradation on people. In international law, generally, there is no mechanism for compensation for people injured from environmental degradation. The concept of environmental justice is a new topic in international law. For this purpose, at first, we try to differentiate between environmental justice and environmentalism. Afterwards, we examine the aspects of environmental justice in regional and international documents for indicating the necessity of a legal system for environmental justice.
