دفاع مشروع در اساسنامه دادگاه کیفری بین‌المللی

در ماده 31 (1) (c) اساسنامه دادگاه کیفری بین‌المللی دائمی 1998، امکان استناد به دفاعیات تبرئه‌کننده ازجمله دفاع مشروع در جنایات بین‌المللی نیز مورد پیش‌بینی قرارگرفته است. در این مقاله با استفاده از روش کتابخانه‌ای و توصیفی تحلیلی و بررسی مفهوم، مبانی دفاع مشروع به‌ویژه مبنای فلسفی، موضوع و نیز شرایط پذیرش آن در مقررات اساسنامه مزبور و با لحاظ پرسش‌های‌ مندرج در آن چنین نتیجه‌گیری شده است که نخست، بهترین توجیه برای مبنای فلسفی دفاع مشروع در پرتو اساسنامه مذکور، نظریه اجرای حق می‌باشد. دوم، موضوع تجاوز در دفاع مشروع علاوه بر تجاوز به نفس و مال، شامل تجاوز به عرض، ناموس و آزادی تن نیز می‌شود. سوم، در صورت امکان فرار برای شخصی که مورد حمله قرار گرفته، تمسک به دفاع مشروع قابل توجیه نیست.

Analysis of Self Defense in the Statute of the Permanent International Criminal Court

In the Statute of the permanent International Criminal Court in 1998 (Article 31(1) (c)), the possibility of appeal to acquittal defense including selfdefense in relation to international crimes has been predicted. Relying upon library and analytical descriptive method and with the aim of the analysis of the rules and issues related to selfdefense within the statute of international criminal court, 1998, and to provide logical comments to eliminate or reduce the ambiguities in its provisions, this article concludes that the best justification for the philosophical basis of selfdefense is the theory of right to selfdefense considering that the circumstances of selfdefense in the Statute have not been accepted clearly. With regard to the license extracted from Article 21, this objection to selfdefense could be solved by reference to the general principles stipulated in national law and other legal systems of the world
