آسیب‌شناسی آموزش و توسعۀ حقوق عمومی در ایران به‌مثابۀ دانشی راهبردی

حقوق عمومی، رشتۀ دانشگاهی محصور در محیط دانشگاه نیست و کارکردها و چالش‌های آن پیوستگی تام و تمام با جامعه و زیست اجتماعی انسان دارد. هر کجا ردّ پایی از قدرت سیاسی را بتوان یافت، آنجا قلمرو حقوق عمومی است. بر این اساس، رشتۀ دانشگاهی آن نیز با رویکردی میان‌رشته‌ای که در آن، حقوق به‌مثابۀ یک پدیدۀ اجتماعی فرض می‌شود، مورد آسیب‌شناسی قرارگرفته است. این مقاله از نظر شیوۀ گردآوری داده‌ها، کتابخانه‌ای میدانی و از حیث روش، توصیفیتحلیلی است. پرسش و پیش‌فرض اصلی مقاله این است که آسیب‌های آموزش حقوق عمومی در سه سطح برنامه‌ریزی آموزشی، آموزش‌دهندگان (اساتید) و آموزش‌بینندگان (دانشجویان) و آموزه‌های آموزشی پژوهشی چیست و راهکارهای مرتفع ساختن نقص‌ها و خلا‌های موجود در این حوزه و متناسب ساختن آن با نیازهای جاری و آتی و اقتضائات کشور کدامند؟ به نظر می‌رسد که آموزش رشتۀ دانشگاهی حقوق عمومی در ایران، دارای آسیب‌های شکلی و ماهوی است و این مهم، توسعۀ معرفت حقوق عمومی را نیز با چالش مواجه کرده است. زیرا یافته‌های مقاله دلالت بر این دارد که راهکار ارتقای سطح آموزش رشتۀ دانشگاهی حقوق عمومی، ضمن ضرورت بازنگری در برنامه‌ریزی‌های آموزشی و سازوکارهای ناظر بر آن، از رهگذر غنای معرفت آن بوده و این مهم با پیاده‌سازی نظریۀ دولت قانونمند محقق خواهد شد

Pathology of Education and Development of Public Law in Iran as a Strategic Knowledge

Scientific findings indicate that the path of sustainable social changes pass through the education of manpower. As developed countries considere education the most important national action in the course of development. We believe, the development of Public Law depends on promoting education of Public Law and there is significant relationship between the education and development of public law. This study goes beyond the traditional classification of Public Law in the areas of Constitutional Law, Administrative Law, Financial Law and Labor Law and is among the Methodological studies or Foundations of Public Law. The method of this research is from the collection of information EField Library, from the nature of research Analytical and from the ultimate goal of Developmental Research. Conclusions and suggestions of this research state concisely that: There are several problems in the education Public Law in higher education institutions in Iran and its required to revision of the mechanisms, and the of “Iranians ethos” reformation and producing local historical theories in the path of the development of Public Law in Iran.
