نظام انتخاباتی مطلوب مجلس شورای اسلامی در پرتو سیاست‌های کلی انتخابات

نظام انتخاباتی مجلس شورای اسلامی یکی از مهم‌ترین چالش‌های اداره کشور است که به‌عنوان امری راهبردی مورد توجه سیاست‌گذاران، قانون‌گذاران و جامعه حقوقی بوده است. این اهمیت سبب شد تا با ابلاغ سیاست‌های کلی انتخابات در سال 1395، ملاک‌های ضروری جهت اصلاح قانون انتخابات مجلس مشخص شوند. هدف از این تحقیق استفاده از مولفه‌های موجود در این سیاست‌ها برای تعیین نظام انتخاباتی مطلوب برای رفع معضلات کشور است. بررسی پیشینه این موضوع نشان می‌دهد، تاکنون شناسایی الگوی مطلوب مبتنی بر سیاست‌های کلی انتخابات بررسی نشده و از این جهت این اثر واجد وصف بدیع بودن است. سوال اصلی نیز آن است که با عنایت به ملاک‌های مذکور در سیاست‌های کلی انتخابات، الگوی مطلوب نظام انتخاباتی مجلس شورای اسلامی چیست؟ همچنین، با عنایت به جایگاه سیاست‌های کلی نظام در سلسله مراتب هنجاری کشور که به‌موجب بند 2 اصل 110 قانون اساسی نظارت بر حسن اجرای آن‌ها، در صلاحیت آن مقام قرار گرفته و اینکه به استناد بند 15 سیاست‌های کلی قانون‌گذاری- ابلاغی 1398- صراحتاً یکی از اولویت‌های قانون‌گذاری توسط مجلس بایستی اجرایی‌سازی سیاست‌های کلی باشد، موضوع این مقاله یک ضرورت به شمار می‌آید. در این مقاله از روش توصیفی-تحلیلی استفاده شده و شیوه گردآوری کتابخانه‌ای گزینش شده است. نتایج این تحقیق نشان می‌دهد، نظام انتخاباتی اکثریتی تک کرسی، به‌عنوان الگوی مطلوب معرفی گردیده و انطباق بیشتری با ملاک‌های انتخاباتی مذکور در سیاست‌های کلی انتخابات دارد که مقدمات تقنینی آن در دولت و مجلس نیز مطرح شده است.

the desirable electoral system of the islamic council is one of the most important issues that has always been the concern of policy makers, legislators and the legal community. this importance caused the notification of the general election policies in 2015 to specify the necessary criteria for amending the law of the parliament elections. examining the background of this issue shows that in the context of the parliamentary electoral system, the identification of the ideal model based on general election policies has not been investigated so far, and for this reason, this work qualifies as innovative. also, considering the position of the general policies of the system in the normative hierarchy of the country, which according to article 110, clause 2 of the constitution, is under the authority of that authority to supervise their proper implementation, and that based on clause 15 of the general legislation-information policies of 2018- obviously, one of the priorities of legislation by the islamic council should be the implementation of general policies, the subject of this article is considered a necessity. in this article, descriptive-analytical method is used. the results of this research show that the single-seat majority electoral system has been introduced as a desirable model and is more compatible with the electoral criteria mentioned in general election policies, whose legislative preparations have also been proposed in the government and parliament.
