تبیین نظم شهر اسلامی بر اساس احکام ثابت

نظم شهر اسلامی را می‌توان با نظم فطری تعریف و تبیین کرد. نظم یک بایستۀ فطری و بدیهی در خلقت الهی است که در ابعاد مختلف و نظام‌های اجتماعی و فرهنگی، کالبدی، زیست‌محیطی، طبیعی و اعتقادی امکان بررسی و مطالعه دارد. نظم فطری هم بنا به آیات قرآن بر اصول ثابت و تغییرناپذیری استوار است. احکام ثابت، همان قانون‌های شریعت هستند که بر اساس فطرت انسان برای انسان‌ها وضع شده است. احکام اعتباری، قانون‌های متغیر هستند که بر طبق نیاز و مصلحت جامعه در دوره‌های مختلف ایجاد می‌شوند. در این زمینه پرسش‌های پژوهش حاضر عبارت است از اینکه اصول و احکام ثابت و نظم‌دهنده در شهر اسلامی چیست؟ ویژگی‌ها و معیارهای عملی احکام ثابت در شهر اسلامی کدامند؟ احکامی که بر زندگی مسلمانان تاثیر می‌گذارند و به‌عنوان سیستم نظم‌دهنده، شهر اسلامی را شکل می‌دهند و تعریف می‌کنند. احکام ثابت و فطری به‌عنوان قانون‌ها و اصول تغییرناپذیری در شهر اسلامی در طول زمان‌ها و مکان‌های مختلف ثابت بوده و تبعیت از آنها امری فطری و الهی است. احکام ثابت را می‌توان در قالب چهار دستۀ قانون‌های اخلاقی، عبادی، اجتماعی، خلقت زیست‌محیطی دسته‌بندی کرد. همچنین مهم‌ترین شاخص و معیار ثابت در شهر اسلامی قاعدۀ حلال و حرام بوده که همیشه ثابت و تغییرناپذیر است. قانون‌ها و مقررات اعتباری در شهر اسلامی قراردادهایی هستند که در زمان‌ها و مکان‌های مختلف برای تامین نیازهای مختلف جامعه و حل مسائل آن و نیز توسعه و پیشرفت شهری و جامعه، به شرط هماهنگی و تبعیت از احکام ثابت تدوین و اعمال می‌شوند.

Islamic city could be define the order and the natural order. Order a natural and obvious divine creation is necessary that the different dimensions of the social system and cultural, physical, environmental and natural, is believe to be studied. The natural order is constant and unchangeable is based on the principles of the Qur'an. The convention's principles fixed in Sadra philosophy and theory Tabatabai Sdaryy philosophy is developed, called principals attending the other rules should also be compatible with the principals of the situation. Order as a fundamental basic characters of God”s creation and has great role in Islamic principles spatialy Quraan and Hadis. Order in Islamic city is affected from fondamental principle, Unity and is emergened in social, cultural, physical, geometry and natural dimentions. In Islamic city, every order related to dynamic and unified system. These systems related to Islamic principles or were compatible with them that be in muslems life. Regard to these principles and laws as natural belifs”s muslems is obvious. Respectance to existant order of Islamic city that and attention to it in planning are neccessery. Life and sustailbility of Islamic city is cooprated with order and Unity. Chaos in Urban order will creat crisis and colaps of Islamic city.
