Oday, the development of cyberspace and the internet helps intrusive communications strategy and has guided them. today, perhaps there are rare organizations and offices that are not present in cyberspace and do not use computers and networks. the use of computers to some extent has taken into consideration; which is one of the indicators of literacy in computer sciences. considering the present century, the increasing use of computers and computer software between different levels of society, spyware and malicious viruses are spread. this study refers to an effective definition and investigates the changing methods of collecting information and progress and developing the modes of communication in cyberspace, in relation to the question whether the passive defense measures could prevent espionage from police in cyberspace? in response to this, the methods of application and data collection tools for reading books, articles and legal documents used for an library research. the results indicate the targeted use of passive defense measures to counter espionage in cyberspace of police and researchers in this area have to offer helpful suggestions.
