شناسایی الگوی مطلوب بیمه مسئولیت حرفه‌ای برای کارکنان پلیس

زمینه و هدف: ازجمله مسائل مهم در ارتباط با بیمه مسئولیت حرفه‌ای کارکنان پلیس، افزون‌بر موضوع جبران خسارت، بررسی تاثیر بیمه مسئولیت حرفه‌ای بر مولفه‌هایی ازجمله مسئولیت‌پذیری کارکنان پلیس و معرفی یک طرح بیمه مسئولیت کارآمد در تنظیم این‌گونه از قراردادهای بیمه است. بر این اساس، هدف مقاله کنونی، شناسایی الگوی مطلوب در بیمه مسئولیت حرفه‌ای کارکنان پلیس از طریق مقایسه الگوهای مختلف با یکدیگر و تاثیر آنها بر عواملی چون میزان مسئولیت‌پذیری کارکنان پلیس، قابلیت بازدارندگی و ایجاد اعتماد متقابل میان پلیس و جامعه است.روش: پژوهش کنونی از نظر نوع، کاربردی است و داده‌های پژوهش به روش کیفی و براساس فیش‌برداری و فهرست‌نویسی از منابع معتبر کتابخانه‌ای و اینترنتی ازجمله کتب، فصلنامه‌ها، رساله‌ها و پایان‌نامه‌ها جمع‌آوری و برمبنای مطالعات توصیفی و بدون استفاده از ابزارها و شاخص‌های آماری، دسته‌بندی شده است. سپس به روش توصیفی و تحلیلی در چارچوب مبانی نظری تحقیق، داده‌ها بررسی شده است.یافته‌ها: مهم‌ترین الگوهای اجرای بیمه مسئولیت حرفه‌ای کارکنان پلیس به‌ترتیب عبارت از بیمه مسئولیت انفرادی، بیمه مسئولیت جمعی اولیه و درنهایت بیمه مسئولیت جمعی تعدیل‌شده است که اعمال هر یک از آنها می‌تواند تاثیرات متفاوتی از حیث میزان حمایتی‌بودن بیمه و اثرگذاری آن بر مسئولیت‌پذیری کارکنان داشته باشد.نتایج: یافته‌های پژوهش حاکی از آن است که «بیمه مسئولیت جمعی تعدیل‌شده» به‌عنوان الگوی مطلوب و عملی در اجرای قراردادهای بیمه مسئولیت حرفه‌ای برای کارکنان پلیس از حیث شمول آن نسبت به تامین جنبه‌های حمایتی جبرانی و نیز نظارتی بیمه‌های مسئولیت حرفه‌ای قابل‌طرح و اجراست و اتخاذ آن در حقوق داخلی با توجه به ظرفیت‌های قانونی موجود، ضمن افزایش مسئولیت‌پذیری کارکنان به بهترین نحو، منافع شخصی کارکنان را با منافع سازمانی پلیس همسو می‌کند.

background and purpose: among the important issues related to the professional liability insurance of police officers, in addition to the issue of compensation, is the investigation of the effect of professional liability insurance on components such as the responsibility of police officers and the introduction of an efficient liability insurance plan in setting up such insurance contracts. based on this, the aim of the present article is to identify the ideal pattern in the professional liability insurance of police officers by comparing different patterns with each other and their effect on factors such as the level of responsibility of police officers, the ability to deter and build mutual trust between the police and society.method: the current research is applied in terms of type, and the research data was collected using a qualitative method and based on scanning and cataloging from reliable library and internet sources such as books, periodicals, treatises and theses, and based on descriptive studies and without using statistical tools and indicators. has been then, the data has been analyzed using a descriptive and analytical method in the framework of the theoretical foundations of the research.findings: the most important models of implementing professional liability insurance for police officers are individual liability insurance, basic collective liability insurance, and finally modified collective liability insurance, the application of each of which can have different effects in terms of the level of insurance support and its effect on the employees’ responsibility. .results: the findings of the research indicate that adjusted collective liability insurance as a desirable and practical model in the implementation of professional liability insurance contracts for police officers in terms of its inclusion in terms of providing compensatory and supervisory aspects of professional liability insurance can be proposed and implemented and adopted. it aligns the personal interests of the employees with the organizational interests of the police in the domestic law, according to the existing legal capacities, while increasing the responsibility of the employees in the best way.
