ظرفیت‌های اجتماعی پیشگیرانه از جرم: تعهد اجتماعی و رفتار اخلاقی به‌عنوان عوامل بازدارنده قانون‌گریزی

زمینه و هدف: قانون‌گریزی، یک تهدید جدی علیه امنیت عمومی است. قانون‌گریزی، وظیفۀ حکومت و اجتماع در حفاظت از شهروندان، سازمان‌ها و نهادها بر ضد تهدیداتی است که درباره امنیت مالی و جانی‌شان به‌وقوع می‌پیوندد. این پژوهش با هدف بررسی تاثیر تعهد اجتماعی بر قانون‌گریزی با میانجی‌گری رفتار اخلاقی انجام شده است.روش: پژوهش کنونی به روش توصیفی- پیمایشی و با نمونه آماری 265 نفری از دانشگاه آزاد اسلامی تبریز در سال 1398 به وقوع پیوسته است. برای جمع‌آوری اطلاعات میدانی از ابزار پرسش‌نامه و برای تحلیل داده‌ها از دو نرم‌افزار اس‌پی‌اس‌اس و پی‌ال‌اس بهره‌گیری شده است‌.یافته‌ها: جامعه باید براساس ظرفیت‌های نهفته در سلول‌های خود (افراد) کنترل شوند. با بررسی تعهد اجتماعی و رفتار اخلاقی افراد در پیش‌بینی قانون‌گریزی به این نتیجه دست یافتیم که هر چقدر در یک جامعه، افراد از تعهد اجتماعی (شامل قانون‌پذیری، مسئولیت‌پذیری، عام‌گرایی و تعامل اجتماعی) و رفتار اخلاقی بالایی برخوردار باشند، به تناسب تبیین واریانس گزارش‌شده در نتایج، میزان قانون‌گریزی کاهش یافته و افراد به صورت خودکنترلی عمل می‌کنند. این اتفاق در وهله اول، پدیده‌ای انضباطی و پیشگیری از قانون‌گریزی بوده و در وهله دوم یک فرهنگ‌سازی بسیار قوی اجتماعی تلقی می‌شود که افراد درنتیجه قانون و مسئولیت‌پذیری، عام‌گرایی و تعامل اجتماعی، ابراز رفتار اخلاقی نموده و به صورت مستقیم و غیرمستقیم از دو بُعد تعهد اجتماعی و رفتار اخلاقی نسبت به قانون‌گریزی، مهار می‌شوند.نتیجه‌گیری: نتایج این پژوهش، نقش تعهد اجتماعی و بروز رفتار اخلاقی را در رابطه با کنترل قانون‌گریزی برجسته کرده و گامی موثر در فرهنگ‌سازی خودکنترلی جامعه با تقویت تعهد اجتماعی و ملاحظات رفتار اخلاقی برداشته است. نتایج پژوهشگران به استفاده از ظرفیت‌های نهفته در سلول‌های جامعه (افراد) و بسیج عموم درراستای خودکنترلی نسبت به پیشگیری از جرم تاکید دارد.

social potentials to prevent crime: social commitment and moral behavior as deterrents to law evasion

background and aim: law evasion is a serious threat to public security, and it is the duty of the government and society to safeguard citizens, organizations and institutions against threats to their financial and life security. the present study is aimed to evaluate the effect of social commitment on escaping law with the mediating role of moral behavior. method: this is a descriptive- survey research with a statistical sample of 265 people from islamic azad university of tabriz in 2019. the field data were collected using a questionnaire and spss and pls software is used for data analysis. findings: we found that the society should be controlled based on the latent potentials in individuals. by examining the social commitment and moral behavior of people in predicting law evasion, it was concluded that the higher the social commitment (e.g. rule of law, responsibility, universality and social interaction) and moral behavior, the lower law evasion and people act as self-controlled based on determining the reported variance in the results. first, this event is a disciplinary phenomenon and prevention of law evasion, and second, it is considered a very strong social norm that people express moral behavior as a result of law and responsibility, universality and social interaction and are controlled directly and indirectly from two dimensions of social commitment and moral behavior towards law evasion. results: the results of this study highlighted the role of social commitment and the occurrence of moral behavior regarding the control of law evasion and took an effective step in enhancing self-control of society by strengthening social commitment and moral behavior considerations. also, the results of the researchers of this study showed the emphasis on using latent potentials of the individuals in society to enhance self-control toward crime prevention.
