نگرشی بر اجرای دیدگاه پیشگیری ترمیمی در نهاد پلیس (با تاکید بر اصول بنیادین پیشگیری از جرم و عدالت ترمیمی)

زمینه و هدف: پیشگیری و کاهش جرایم، از دیر باز مدنظر سیاستگذاران دستگاه عدالت کیفری بوده است. پلیس به‌عنوان یکی از ارکان این دستگاه، پیشگیری از جرم را در اولویت برنامه‌های خود قرار داده و سال های اخیر به دنبال رویکردهایی با قابلیت‌های جدید در این زمینه بوده است. استفاده از قابلیت های جدید مانند رویکردهای ترمیمی که به بزه‌دیده و بزهکاری، نگاهی متفاوت دارد، ازجمله برنامه هایی است که مورد توجه پلیس قرار گرفته است. پژوهش کنونی با هدف تعیین اصولی قابل استفاده و کاربردی برای پلیس انجام شده است تا با استفاده از آن، برنامه‌ای نو برای پیشگیری از جرم با عنوان پیشگیری ترمیمی، اجرا نماید.روش: این پژوهش به روش توصیفی- تحلیلی با تاکید بر اسناد پیشگیری از جرم و اصول بنیادین به‌کارگیری برنامه‌های عدالت ترمیمی در امور کیفری، انجام شده است.یافته‌ها: یافته‌ها نشان می‌دهد که برنامه‌های پیشگیری ترمیمی پلیس یعنی استفاده و بهره‌برداری از هر برنامه یا روشی در پلیس که از فرایندهای ترمیمی استفاده می‌کند، به دنبال رسیدن به پیشگیری از جرم و تکرار آن است. بر همین اساس، پیشگیری ترمیمی یک رویکرد تلقی می‌شود که می‌تواند با شرایط مختلف تطبیق یافته و مسیرهای جایگزینی را برای پیشگیری از جرم پیشنهاد کند.نتیجه‌گیری: پلیس با تغییر در سیاست‌ها و تغییر نگرش به سمت برنامه‌های پیشگیری ترمیمی، می تواند بدون تغییر در ساختارها و تنها با تمرکز بر این گام‌ها، از تکرار بزهکاری و بزه‌دیدگی دوباره، پیشگیری کند و همه سهامداران جرم را برای پذیرش مسئولیت پیشگیری از جرم هماهنگ نماید.

an attitude on the implementation of the restorative prevention perspective in the police institution(with emphasis on the fundamental principles of crime prevention and restorative justice)

background and purpose: prevention and reduction of crimes has been considered by the policymakers of the criminal justice system since long ago. as one of the pillars of this system, the police has made crime prevention a priority in its programs and in recent years has been looking for approaches with new capabilities in this field. the use of new capabilities, such as restorative approaches that have a different look at victims and delinquents, are among the programs that have attracted the attention of the police. the current research has been done with the aim of determining usable and practical principles for the police to use it to implement a new crime prevention program called restorative prevention. method: this research was carried out using a descriptive-analytical method with an emphasis on crime prevention documents and the fundamental principles of applying restorative justice programs in criminal matters.findings: the findings show that police restorative prevention programs mean the use and exploitation of any program or method in the police that uses restorative processes and seeks to prevent crime and its repetition. accordingly, restorative prevention is considered an approach that can be adapted to different conditions and suggest alternative paths for crime prevention.conclusion: by changing the policies and changing the attitude towards restorative prevention programs, the police can prevent the repetition of crime and re-victimization without changing the structures and focusing only on these steps, and all stakeholders of the crime to accept the responsibility of preventing coordinate crime.
