الزامات تشکیل پلیس ویژه اطفال و نوجوانان در دادرسی افتراقی کودکان بزه‌دیده

زمینه و هدف: پلیس در میان تمامی نهادهای عدالت کیفری که با کودکان ارتباط دارند، به‌علت مواجهه مستقیم با این قشر، نقشی بنیادین در روند دادرسی ایفا می‌کند. این موضوع سبب شده که یکی از مهمترین جلوه‌های افتراقی‌سازی دادرسی کیفری، کنش متفاوت پلیس در مواجهه با بزه‌دیدگی کودکان تلقی شود. این مقاله با هدف بررسی جایگاه پلیس ویژه اطفال و نوجوانان در دادرسی افتراقی کودکان بزه‌دیده به رشته تحریر درآمده است. در این راستا ضمن تبیین شاخص‌های موضوع، وضعیت موجود بررسی و با نگرشی به اسناد بین‌المللی، وضعیت مطلوب تبیین می‌شود.روش: پژوهش کنونی به روش تحلیلی- توصیفی و با استفاده از منابع کتابخانه‌ای صورت گرفته است؛ همچنین گردآوری اطلاعات به روش اسنادی و از طریق مطالعه قوانین، اسناد بین‌المللی و منابع معتبر انجام شده است.یافته‌ها: براساس یافته‌های پژوهش، در قانون حمایت از اطفال و نوجوانان به نقش پلیس در موضوع بزه‌دیدگی کودکان، توجه چندانی نشده است و در لایحه پلیس ویژه نیز با وجود پیش‌بینی تدابیر مناسب و قابل‌دفاع، در برخی از حوزه‌ها مانند آگاه‌سازی کودکان بزه‌دیده از روند رسیدگی و امنیت کودکان بزه‌دیده، نقایصی ملاحظه می‌شود.نتیجه‌گیری: در حقوق ایران تدابیر منسجمی در زمینه امنیت کودکان در روند دادرسی، وظیفه پلیس در آشنا کردن کودکان بزه‌دیده با حقوقشان، تعامل پلیس و سازمان‌های مردم‎نهاد، حضور پلیس ویژه در دادرسی اطفال و نوجوانان بزه‌دیده در مراجع اختصاصی و حضور موثر بانوان پلیس در رسیدگی به موضوع بزه‎دیدگی کودکان، پیش‌بینی نشده است.

background and purpose: among all criminal justice institutions that are related to children, the police play a fundamental role in the judicial process due to their direct contact with this group. this issue has caused that one of the most important manifestations of the differentiation of criminal proceedings is the different actions of the police in the face of child abuse. this article has been written with the aim of investigating the position of the special police for children and adolescents in the differential proceedings of child victims. in this regard, while explaining the indicators of the subject, the current situation is examined and the desired situation is explained with an attitude to international documents.methodology: the present research is analytical-descriptive and using library resources; in this regard, information has been collected by documentary method and through the study of laws, international documents and reliable sources.findings: according to the findings of the research, the role of the police in the issue of child victimization has not been given much attention in the law on the protection of children and adolescents, and in the special police bill, despite the provision of appropriate and defensible measures, in some areas such as informing the victimized children of the proceedings and the safety of the injured children, defects are observed.conclusion: in iranian law, there are consistent measures in the field of children’s safety in the trial process, the duty of the police to acquaint victimized children with their rights, the interaction of the police and non-governmental organizations, the presence of special police in the proceedings of child and adolescent victims in special authorities, and the effective presence of policewomen. there is no provision for handling the issue of child victimization.
