اخلاقِ عدالت ترمیمی و نقش آن در استقرار امنیت اجتماعی

مقدمه: پژوهش حاضر به بررسی اخلاق عدالت ترمیمی و نقش آن در امنیت اجتماعی پرداخته است. امروزه، صرفاً با شناسایی اصول و قواعد انتزاعیِ الگوی عدالت ترمیمی نمی‎توان به آرمان‎های مدنظر آن دست یافت، بلکه نیازمند راهکار و ابزار مقتضی هستیم. روش: در این پژوهش از روش توصیفی-تحلیلی و ابزار فیش‎برداری استفاده شده است؛ مسئله ما، چندتباری و رهیافت ما، میان‎رشته‎ای است. یافته‎ها: نخست، تبیین ارزش‎ها و اصولِ اخلاق عدالت ترمیمی؛ دوم، تبیین مدیریت اخلاق عدالت ترمیمی و ارکان سند جامع اخلاقی در راستای ترویج هرچه بیشتر مسئولیت اخلاقی متصدیان عدالت مذکور؛ سوم، تصنیف ادبیات اخلاق عدالت ترمیمی، و نقش ارزش‎ها و اصول آن بر امنیت اجتماعی. نتیجه‎گیری: برنامه‎های عدالت ترمیمی تحت الگویی مبتنی بر اخلاق، تنظیم نشده است. ضرورت دارد که حقوق در قید اخلاق بُرده شود؛ کنشگران عدالت ترمیمی شایسته است برای تحقق اخلاق، مدیریت اخلاق را به‎عنوان بخشی راهبردی و راهکار مقتضی در سازمان تعریف کرده و با شناخت کامل از عناصر محیط، حقوق هر یک از آنها و طبقه‎بندی آنها، به تدوین بیانیه اخلاقیِ عدالت ترمیمی به‎عنوان ابزار مقتضی، دست یافته و زمینه و فرهنگ التزام به اخلاق عدالت ترمیمی را ایجاد کنند. التزام به اخلاق مذکور، انجام وظایف و نحوه رفتار کنشگران عدالت مذکور با رعایت اصول اخلاقی را عملی، و کیفیت خدمات ارائه شده را تضمین و میان مردم اعتماد و امنیت ایجاد می‎کند.

Ethics of restorative justice and its role in social security

Introduction: the present study examines the ethics of restorative justice and its role in social security. It seems that, by recognizing the abstract principles and rules of restorative justice, its intended ideals cannot be achieved, rater, we need the right solution and tools. Method: in this research, descriptiveanalytical method and fish taking tools have been used, our problem is multilingualism and our approach is interdisciplinary. Findings: explaining the values and principles of restorative justice ethics, explaining restorative justice ethics management and the elements s of a comprehensive ethical document in order to promote the moral responsibility of the restorative justice administrators as much as possible. Conclusion: restorative justice programs are not regulated under an ethical model. It is necessary to take the rights in the context of ethics, restorative justice activists, it is appropriate to define ethics, ethics management as a strategic part and appropriate solution in the organization and with full knowledge of the elements of the environment, the rights of each of them and their classification, to formulate the ethical statement of restorative justice as an appropriate tool, and to create the context and culture of adherence to the ethics of restorative justice. Adherence to the above ethics, performing the duties and behavior of the abovementioned justice activists in compliance with the necessary ethical principles, and ensuring the quality of services provided, and ultimate, creates trust and security among the people.
