امنیت قضایی در مرحله دادرسی در حقوق کیفری و رویه قضایی و چالش‌های فرارو

مقدمه: در این مقاله ابعاد و جلوه‌های امنیت قضایی در مرحله دادرسی در حقوق کیفری و رویه قضایی و چالش‌های فراروی آن مورد بررسی قرار گرفته است. امنیت قضایی یکی از مفاهیم بنیادین حقوق شهروندی در مراحل دادرسی قضایی است. سوال اساسی که در این تحقیق مورد بررسی قرار گرفته، این است که مولفه‌های امنیت قضایی در مرحله دادرسی تا چه اندازه در حقوق کیفری ایران موردتوجه قرار گرفته و چالش‌های فراروی تحقق امنیت قضایی کدام است؟ روش: تحقیق حاضر ازنظر روش، تحلیلی توصیفی بوده و یافته‌های آن با استفاده از منابع کتابخانه‌ای تحلیل شده است. یافته‌ها: این تحقیق نشان می‌دهد که عناصر و مولفه‌های امنیت قضایی از قبیل دادرسی عادلانه، علنی بودن دادرسی، اصل بی‌طرفی قاضی، حق احضار شهود، ضابطین علمی و قانونمند، حق دسترسی به وکیل و سلب حق ارجاع پرونده از دادستان و واگذاری آن به قاضی ارجاع مستقل از مهم‌ترین مولفه‌های امنیت قضایی است که در حقوق کیفری و رویه قضایی ایران موردتوجه قرار گرفته است. نتیجه‌گیری: نتایج تحقیق بیانگر این امر است که مواردی چون اطاله دادرسی، ناکارآمدی و عدم پاسخگویی دستگاه قضایی، عدم وجود پلیس علمی و کارآمد می‌تواند به‌عنوان چالش‌های امنیت قضایی در حقوق کیفری ایران نمود پیدا کند.

Judicial Security during the Proceeding in Criminal Law and Legal Precedent and Its Challenges

Abstract Introduction:This paper deals with the aspects and manifestations of judicial security during the Proceeding in Criminal Law and Legal Precedent and Its Challenges. Judiciary security is one of the fundamentals concepts in citizenship law in the judiciary proceeding steps. The fundamentals questions investigated in this research is that to what extend the judiciary security components are considered in proceeding in Iran criminal law and what the challenges are for realization of judiciary security? Method: This research is a descriptive one conducted on a librarian based method Finding: The research outcomes reveal that the judicial security such as: fair proceeding, open proceeding, the judge neutrality, the right for summoning witness, the right for having access to attorney and depriving the right for referring the case from public prosecutor to the judge and independent refer are among the most important components of judiciary security which are considered in Iran criminal law and its legal precedent. Result:The finding also shows that some matters such as proceeding prolongation, lack of efficiency and lack of responsibility by the justice administration are the appeared to be judiciary security challenges in Iran criminal law Key words: judiciary security, proceeding, legal precedent, fain proceeding, open proceedin.
