چکیده
|
»زبان حقوقی « تکیهگاه استدلالی محکمی برای دفاع از سلامت فراهم کرده است؛ بهطوریکه، قواعد حقوق بشر، بهعنوان عمدهترین ارزش سیاسی جهانیشدن، در قلب تئوری و عمل گفتمان سلامت عمومی، جای گرفته است و قدرت لازمالاجرابودن آن میتواند به تضمین توزیع عادلانهی منابع سلامت در کشورها کمک کند؛ در عینِحال، حق سلامت، حقادعایی که در اسناد بینالمللی و ملی شناسایی شده است، خود مستلزم پیششرطهایی است که بدون وجود زمینهی مناسب فرهنگی، اجتماعی، اقتصادی و سیاسی و بهطور کلی، عوامل شکلدهندهی »زمینهی زندگی مردم «، تحقق نمییابد؛ بهعبارتی، استدلال با زبان حقوقی برای سلامت، میتواند با خود، استدلالِ حق بر تعیینکنندههای سلامت را به دنبال داشته باشد؛ از همین رو، این مقاله با اتخاذ رویکردی معرفتشناسانه، روایتی حقوقی از منطق حکمرانی برای سلامت ارائه میکند که چشماندازی تازه از مباحث »حق سلامت « پیش رو گذاشته است و با استدلالهایی قدرتمند، نشان میدهد که سیاستگذاری سلامت، باید مبتنی بر فهم موضوعاتی باشد که تاثیراتی عمده بر سلامت مردم دارند؛ موضوعاتی که با عنوان عوامل »تهدیدکنندهی سلامت «، »محافظتکنندهی سلامت « و »ارتقادهندهی سلامت « توصیف میشوند؛ گرچه، مطالبهی ادعایی حق سلامت، بهمثابه »حق لازمالاجرای فردی «، انتقاداتی را هم در پی داشته و ممکن است موانع و محدودیتهایی نظری و عملی پیش روی تحقق کامل این حق بشری وجود داشته باشد.

Abstract
|
The Legal language has provided a strong supportive argument for right to health advocacy. In such a way that, human rights rules has been established as the most important globalized political value at the heart of the theory and practice of public health discourse. Its power of enforceability guaranties fair distribution of health resources in each country. At the same time, the right to health, the ldquo;Rightclaim rdquo; which has been identified by international and national documents requires preconditions that will not come true without the proper cultural, social, economic, and political infrastructures, in general the factors shaping the context of peoplechr('39')s lives rdquo;. In other words, a legal reasoning for right to health can be followed by an argument for the right to health determinants. Therefore, by adopting an epistemological approach, this paper presents a legal narrative of ldquo;governance for health rdquo;. This paper creates a new perspective on the right to health debates. Additionally, it provides powerful arguments that health policy should be based on a perception of factors with major impacts on the people health and what have being described as health hazard , health protector , and health promoter . However, this claim for right to health as an individual enforceable right is criticized, and there may be theoretical and practical obstacles to the full realization of this human right.
