ملاحظات اخلاقی در احترام به استقلال بیمار و حق امتناع از درمان؛ گزارش موردی

یکی از موقعیت‌های چالش‌برانگیز در اقدامات درمانی، زمانی است که بیمار، به‌طور جدی و مصرّانه، از درما‌ن‌های مدِّنظر پزشکان معالج، امتناع می‌کند. امتناع از درمان، به شرط آگاهانه‌بودن، حق بیمار است؛ اما اینکه چنین حقی تکلیفی اخلاقی را هم متوجه پزشک معالج می‌کند یا خیر، مساله‌ای است که در این مقاله، به‌صورت موردی، در بیماری با تشخیص لوپوس سیستمیک، درباره‌ی آن بحث می‌شود. در این مقاله سعی شده است بر ملاحظات اخلاقی در اخذ رضایت آگاهانه، با وجود امتناع بیمار از درمان، مروری اجمالی شود. در این گزارش، با توجه به سن بیمار، این‌گونه می‌توان نتیجه گرفت که هرچند بیمار ظرفیت تصمیم‌گیری دارد، ازآنجاکه سن او کمتر از سن قانونی است و صلاحیت تصمیم‌گیری ندارد، نمی‌توان امتناع او را از درمان پذیرفت و باید بر اساس مصالح عالیه‌ی او و با کسب نظر قیم قانونی واجد صلاحیت، دراین خصوص، با درنظرگرفتن جوانب علمی تصمیم‌گیری کرد.

Ethical Considerations in Respecting Patient's Autonomy and Right to Refuse Treatment: A case Report

One of the most challenging aspects of treatment is when patient seriously refuses the desired by treating physician. On the other hand, refusing treatment is a condition of the patientchr('39')s right to be aware, but does such a right also imposes a moral obligation on the treating physician or not? This study discusses the diagnosis of Systemic Lupus Erythematosis disease. This article attempts to provide an overview of the ethical considerations for obtaining informed consent for a patient who refuses treatment. In this report, according to the patientchr('39')s age, it can be concluded that although the patient has the capacity to make decisions, but because her age is below the legal age and does not have the authority to decide, her refusal to receive treatment cannot be accepted and it is necessary to make a decision based on the supreme interests of the patient with the opinion of a qualified legal guardian in this regard, taking into account the scientific aspects.
