بررسی شاخص‌های پسادرمانی مسئولیت پزشکان

صاحبان حِرَف پزشکی می‌کوشند خدمات درمانی را به‌صورت کارآمد، مطلوب و باکیفیت به بیماران ارائه دهند؛ بااین‌حال، درمان‌های پزشکی، مصون از خطا و اشتباه نیستند؛ بنابراین، حدوث آسیب متعاقب درمان‌های پزشکی، امری اجتناب‌ناپذیر است؛ موضوعی که می‌تواند منتهی به شکایت علیه کادر درمان شود. با به‌جریان‌افتادن پرونده‌های این‌چنینی، اخذ نظریه‌ی کارشناسی ضرورت می‌یابد؛ ازهمین‌رو، وقوف به شاخص‌های موثر در محکومیت، ضمن اثربخشی در تقلیل رفتارهای آسیب‌زا، می‌تواند در افزایش بینش کادر درمان نیز، مفید باشد. مداقه در پرونده‌های تخلفات پزشکی، گویای آن است که شاخص‌های محکومیت، در دو دسته‌ی پیشا و پسادرمانی جای می‌گیرند. خطاهای حادث‌شده پس از ورود به اجرای مراحل درمان، گویای معیار پسادرمانی‌ ‌است. نقص در خاتمه‌ی فرایند درمان، انجام‌ندادن اقدامات درمانی در محل مناسب، عدم تناسب یا اشتباه در روش به‌کاررفته و تقصیر یا اشتباه فاحش، اهم موارد مسئولیت‌زای مرتبط با این شاخص ‌است. پژوهش حاضر بر آن است تا به‌ شیوه‌ی توصیفی‌‌تحلیلی و با استناد به نظریات کارشناسی نوشته‌شده در پرونده‌های قصور و تقصیر پزشکی، معیارهای موثر در محکومیت کارکنان درمانی را بررسی کند.

Examination of Post-Treatment Indicators of Physicians’ Responsibility

Efforts of the medical staff are to provide efficient, desirable, and high quality services to patients. However, medical treatments are not immune to error and mistake. So, occurrence of injury following medical managements is inevitable, an issue that could lead to a lawsuit against the medical staff. In such cases, resorting to experts rsquo; opinion is necessary. Therefore, knowledge about effective indicators in sentencing can increase awareness of the treatment staff in addition to reduction of traumatic behaviors. Reflection on the medical forensic cases shows that the reasons of medic rsquo;s conviction can be divided in two categories including pretreatment and posttreatment factors. Errors after entering the treatment process indicate posttreatment index. Breach at the end of treatment, not doing (lack of) treatment in the appropriate place, mismatch or mistake of used techniques, and fault or blunder are the most important issues related to this index. The present study intends to examine the effective criteria in sentencing medical staff in a descriptiveanalytical manner based on expert opinions rsquo; of medical malpractice cases.
