طراحی الگوی پیش‌گیری کیفری از جرائم و تخلفات رانندگی

زمینه و هدف: بحرانی‌بودن آمار مرتبط با حوادث رانندگی بر لزوم توجه روزافزون و اهمیت تدابیر پیش‌گیری از وقوع این جرائم افزوده است و این موضوع را به دغدغۀ اساسی تبدیل کرده و ضرورت اقدامات پیش‌گیرانۀ کنشی (کیفری) در رابطه با جرائم و تخلفات رانندگی را آشکار کرده است. از این‌رو، هدف پژوهش حاضر، شناسایی مولفه‌ها و شاخص‌های پیش‌گیری از جرائم و تخلفات رانندگی بر طبق نظر خبرگان است.روش: این پژوهش از نظر هدف، کاربردی توسعه ای و از نظر نوع، داده کیفی با رویکرد تحلیل مضمون استفاده شد. جامعه تحقیق را خبرگان و صاحب نظران حوزه پیش‌گیری از جرائم و تخلفات رانندگی و مدیریت ترافیک شهری تشکیل می‌دهد که 8 نفر به روش هدف‌مند انتخاب شدند و برای گردآوری داده ها از ابزار مصاحبه عمیق نیمه ساختاریافته استفاده شد.یافته‌ها: در تحلیل داده های حاصل از مصاحبه در قالب 5 مقوله اصلی شامل پیش‌گیری کیفری و اثرات آن بر اعمال مجازات کیفری، ارتقای سطح عملکردی قوانین و مقررات، کاهش آماج جرم، اقدامات پیش‌گیرانه منجر به مجازات، پیش‌گیری کیفری و غیرکیفری در کاهش تخلفات رانندگی و هم‌چنین ارتباط پیش‌گیری کیفری و اجرای مجازات ها ارائه شد که هرکدام شامل ابعاد و شاخص‌های متعددی بود که اقدامات، قانون گذاری ها، سیاست‌گذاری ها، ضمانت اجراهایی را در قالب 32 مورد ارائه داد.نتیجه‌گیری: پلیس راهنمایی و رانندگی باید با هر وسیله ممکن به سمت یک فرهنگ‌سازی پیش‌گیرانه حرکت کند و افراد را برای اقدامات اشتراکی سوق دهد و با ایجاد و تقویت مشارکت سازمانی و دستگاه های قضایی و انعطاف‌پذیری و رسالت سازمانی قابل‌دست‌یابی خواهد بود.

designing a model for preventing traffic crimes and violations (from the perspective of urban traffic experts and managers in tehran)

background and aim: the criticality of statistics related to traffic accidents has increased the need for increasing attention and importance of measures to prevent theoccurrence of these crimes. has done. therefore, the purposeof this study is to designa model for the prevention of driving offenses and violations according to experts.method: the research method is developmental in terms of purposeand heuristic in terms of qualitative data type, so content analysis was used. thestudy population consisted ofexperts and experts in the field of crime prevention and traffic violations and urban traffic management and the statistical sample included 8 people who were selected by snowballmethod anddata collection was done through semistructured data interviews. data analysis was performed in maxqda software..findings: in analyzing the data obtained from the interview in the form of 5 main categories including criminal prevention and its effects on the application of criminal punishment, improving the functional level of laws and regulations, reducing the target of crime, preventive measures leading to punishment, criminal and noncriminal prevention in the reduction of traffic violations as well as the relationship between criminal prevention and execution of punishments were presented, each of which included several dimensions and indicators that provided actions, legislation, policies, and performance guarantees in the form of 32 cases.conclusion: traffic and driving should move towards a preventive culture building by any means possible and lead people to take joint actions and will be achieved by creating and strengthening organizational participation and judicial systems and flexibility and organizational mission..
