چالش‌های تعیین سهم سازمان‌ها در تصادفات

زمینه و هدف: سه عامل انسان، راه و وسیله نقلیه عوامل اصلی دخیل در وقوع تصادف هستند. در این میان، قانون رسیدگی به تخلفات رانندگی امکان بررسی و تشخیص سهم تقصیرِ عوامل راه یا وسیله نقلیه را در نظر گرفته است. پژوهش حاضر با هدف شناسایی چالش های تعیین سهم سازمان های مختلف در وقوع تصادفات سال 96 در استان تهران انجام شده است.روش: روش پژوهش ترکیبی از روش های کمّی و کیفی بوده است. اطلاعات آماری مربوط به تصادفات دارای سهم تقصیر سازمانی در سال 96 به عنوان اطلاعات کمّی مورد استفاده قرار گرفته است.یافته ها: یافته های کمّی برای شناخت ویژگی های کلی تصادفات دارای سهم تقصیر سازمانی و همچنین تعیین سهم سازمان های مختلف در وقوع آنها مورد استفاده قرار گرفته است. بر این اساس، شهرداری و پس از آن، اداره راه، اداره برق و آبفا بیشترین سهم را داشته اند. در بخش کیفی پژوهش، مصاحبه گروهی از طریق اجرای بحث گروهی متمرکز با تعدادی از کارشناسان تصادفات و مسئولان و افسران راهور استان تهران انجام شده است. تحلیل محتوای کیفی این مصاحبه گروهی با استفاده از تحلیل مضمون جهت تحلیل چالش ها و موانع موجود در اجرای کامل قانون برای تعیین سهم تقصیر سازمان ها مورد استفاده قرار گرفته است.نتیجه گیری: در نهایت با تحلیل مضامین استخراج شده از مصاحبه ها، عواملی همچون مسایل حقوقی و قانونی، عوامل مربوط به کارشناسان تصادفات، عدم تعامل بین سازمانی مناسب و همچنین نقض ماده 23 قانون رسیدگی جهت تامین برخی تجهیزات ترافیکی، موانع مهم اعلام سهم تقصیر سازمان ها در وقوع تصادف شناخته شده اند.

Challenges of determining the share of organizations in accidents(Case study of inner and outer city roads of Tehran province in 1396)

The three factors of man, road and vehicle are the main factors involved in the occurrence of an accident. The Traffic Violations Act provides for the possibility of investigating and determining the share of fault of road or vehicle agents. The aim of this study was to identify the contribution of various organizations in the occurrence of accidents in 1996 in Tehran province. The research method was a combination of quantitative and qualitative methods. Statistical data related to accidents with a share of organizational fault in 1996 has been used as quantitative information. Quantitative findings have been used to identify the general characteristics of accidents with a share of organizational fault and also to determine the share of different organizations in their occurrence. Accordingly, the municipality and then the road department, electricity department and ABFA had the largest share. In the qualitative part of the research, group interviews were conducted through a focused group discussion with a number of accident experts, officials and officers of Rahvar in Tehran province. Qualitative content analysis This group interview has been used using contextual analysis to analyze the challenges and obstacles in the full implementation of the law to determine the fault of organizations. By analyzing the topics extracted from the interviews, factors such as legal issues, factors related to accident experts, lack of proper interorganizational interaction and also violation of Article 23 of the Investigation Law, are important obstacles to declaring the fault of organizations in the accident.
