نحوه اعمال ارکان تحقق مسئولیت مدنی در فضای سایبری اینستاگرام

یکی از عمومی‌ترین جلوه‌های فضای سایبر، اپلیکیشن اینستاگرام است. اینستاگرام همه فضای سایبر نیست اما جزء موثر و در بطن آن است؛ بنابراین از نظر ماهیت، از قواعد و اقتضائات فضای سایبر تبعیت می‌کند. تفاوت ماهیتی فضای سایبر با جهان واقعی، مقتضی تغییر در مفهوم برخی از اصطلاحات حقوقی این فضاست. ازجمله این اصطلاحات، حوزه مسئولیت مدنی است. برای تحقق مسئولیت مدنی، احراز سه رکن ورود ضرر، فعل زیان‌بار و رابطه سببیت لازم است. هر یک از این سه رکن در فضای اینستاگرام، مفهوم و قلمرو خاصی دارد که با جهان واقعی متفاوت است. با توجه به اینکه یکی از کارکردهای مهم این اپلیکیشن، عملکرد رسانه‌ای آن است، در اِعمال قواعد حقوقی بر آن، کارکرد مزبور باید مدنظر باشد. در این مقاله تلاش شده است تا نحوه اِعمال ارکان مزبور در فضای اینستاگرام مبتنی بر روش کتابخانه‌ای مورد بازبینی قرار گیرد. با توجه به کارکرد رسانه‌ای این شبکه و اقتضائات گردش آزاد اطلاعات، نتیجه این است که ضرر در فضای اینستاگرام، مفهومی مضیق از جهان واقعی دارد. همچنین رابطه سببیت در فضای مزبور، وابستگی خود به عرف مادی و رابطه علی و معلولی را از دست داده و احراز آن تابع اقتضائات این فضاست که به‌این‌ترتیب، توجه بیشتر به عامل به‌جای فعل زیان‌بار، راه بهتری برای اثبات سببیت به نظر می‌رسد.

To fulfill civic responsibility, it is necessary to achieve the three pillars of loss, harmful action and causal relationship. Each of these three pillars in the Instagram space has a specific concept and realm that is different from the real world.Given that one of the important functions of this application is its media function, it must be considered in applying the legal rules. This article reviewed the use of these elements in the Instagram space based on the library method. Given the media function of this network and the need for free flow of information, the loss in Instagram space is a narrow concept of the real world. Also, the causal relation in this space has lost its dependence on commonality and causal relationship, and its fulfillment depends on the requirements of this space, so that paying more attention to the agent instead of the harmful act seems to be a better way to prove causality.
