Abstract
background and aim: recognizing the economic value of women's unpaid domestic work is a significant issue at the intersection of islamic jurisprudence, family law, and economic justice. under iranian law, the supplementary provision to article 336 of the civil code and article 29 of the family protection law (2012) provide a legal basis for a wife to claim ujrat al-mithl (fair remuneration based on the customary value of services) for domestic services that are not religiously obligatory and are performed subject to the statutory requirements. nevertheless, the effective realization of this right remains subject to challenges, including establishing that the services were performed at the husband's request, determining the scope of activities beyond the wife's religious obligations, assessing the evidentiary implications of the wife's intention to perform the services gratuitously (tabarru'), and the lack of uniform standards for judicial expert assessment.materials and methods: this doctrinal legal study employs a descriptive-analytical approach. it examines relevant iranian legislation, unifying precedent no. 779 of the general board of the supreme court, recent advisory opinions issued by the legal department of the judiciary, primary and secondary sources of imami jurisprudence, and the works of imam khomeini. the findings are subsequently examined in light of selected international human rights standards and sustainable development goal 5.4 concerning the recognition and redistribution of unpaid care and domestic work.ethical considerations: the study adhered to the ethical principles governing academic research, particularly academic integrity, accurate representation of sources, and faithful reporting of findings.findings: the analysis yields four principal findings. first, article 265 of the civil code does not constitute the direct legal basis for a wife's claim for ujrat al-mithl; article 336 provides the primary legal foundation for such claims. second, pursuant to advisory opinions nos. 7/364/1400 and 7/561/1401, the wife's silence during the course of marital life cannot, by itself, be construed as evidence of an intention to perform domestic services gratuitously (tabarru'). third, nehleh, as a distinct legal institution with a specific statutory basis and scope, cannot be interpreted as an unrestricted judicial discretion to award compensation whenever a claim for ujrat al-mithl cannot be established. fourth, unifying precedent no. 779 recognizes the possibility of combining the marital property-sharing condition with ujrat al-mithl, or with nehleh where applicable, rather than treating these mechanisms as mutually exclusive in all circumstances.conclusion: achieving more effective economic justice in relation to compensation for a wife's domestic work does not primarily require the creation of a new legal entitlement. rather, it requires a coherent interpretation and application of the existing legal framework, greater standardization and transparency in expert assessments, clearer identification of admissible evidence, and a systematic distinction between the jurisprudential foundations of imami law, the requirements of iranian domestic law, and relevant international human rights standards. such an approach can contribute to a more consistent and equitable recognition of the economic value of unpaid domestic work within the iranian family-law system.
