تحلیلی بر حق مسکن در حقوق اسلام و اسناد حقوق بشری

زمینه و هدف: در اصل سوم قانون اساسی، دولت موظف است هر نوع محرومیتی را در زمینه مسکن برطرف و موارد مهم در اعلامیه‌های جهانی و قوانین دولت‌ها آمده اس که برخورداری از مسکن به­ عنوان یکی از حقوق اساسی مردم که محل استراحت و سکونت شخص محسوب می‌شود و هدف رسیدن به آرامش روحی و جسمی در پرتو دارا بودن مسکن، یکی از نیازهای همه جوامع بشری است. مواد و روش ­ها: این پژوهش به­ صورت توصیفی– تحلیلی تدوین شده است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده استیافته ­ها: به­دلیل اهمیت زیاد حق مسکن، این حق در کنوانسیون محو کلیه اشکال تبعیض نژادی، کنوانسیون حقوق کودک، کنوانسیون محو کلیه اشکال تبعیض علیه زنان و کنوانسیون مربوط به وضعیت پناهندگان نیز صراحتاً مورد اشاره واقع شده است و از سوی دیگر بیش از 50 کشور به گونه‌ای آزادی مسکن را در قوانین اساسی خود گنجانده‌اند.نتیجه: با توجه به اصل 43 قانون اساسی که یکی از پایه‌های اقتصاد جمهوری اسلامی ایران بر تامین مسکن به عنوان نیاز اساسی جامعه و در بند 2 ماده 2 اعلامیه جهانی حقوق بشر اسلامی به عنوان ضرورت برای زندگی با کرامت و ضمانت برای افراد خانواده می باشد. با این وجود، دولت ها با تلاش بسیار هنوز نتوانسته ­اند این امر مهم را به­ طور کامل محقق سازند.

background and aim: in the third article of the constitution, the government is obliged to eliminate any kind of deprivation in the field of housing, and important matters are mentioned in the universal declarations and laws of governments; having housing as one of the basic rights of the people, which is considered a place of rest and residence of the person, and the goal of achieving mental and physical peace in light of having housing is one of the needs of all human societies.materials and methods: this research is written in a descriptive-analytical manner.ethical considerations: in all stages of writing this research, the originality of the texts, honesty and trustworthiness have been observedfindings: due to the great importance of the right to housing, this right has also been explicitly mentioned in the convention on the elimination of all forms of racial discrimination, the convention on the rights of the child, the convention on the elimination of all forms of discrimination against women, and the convention relating to the status of refugees, and on the other hand, more than 50 countries have included freedom of housing in their constitutions in some way.conclusion: in view of article 43 of the constitution, which is one of the foundations of the economy of the islamic republic of iran, providing housing as a basic need of society and in article 2, paragraph 2 of the universal declaration of human rights in islam as a necessity for living with dignity and guaranteeing family members. however, despite great efforts, governments have not yet been able to fully realize this important matter.
