ظرفیت‌های فقه تمدن ساز شیعه

هدف از این مقاله، بررسی چگونگی مفهوم شناسی فقه تمدن شیعه و بررسی ظرفیت‌های عمومی و اختصاصی فقه تمدن شیعه، برای نظام سازی توحیدی بر اساس یافته‌های اسلامی با رویکرد تمدنی (تبار شناختی) است. این مقاله با روش تحلیلی- توصیفی نوشته‌شده است. پژوهش حاضر بعد از تبیین لغوی و اصطلاحی فقه، تشیع و تمدن، به ره‌یافت‌های نظام سازی در فقه تمدن می‌پردازد. در این راستا تاثیر فقه شیعه بر علوم به جهت حجیت یابی علوم در تولید، توزیع، انباشت، روش، هدف، کاربردهای توحیدی بررسی شد. فقه تمدن شیعه با منبع وحیانی و بکار گیری عقل فطری و با استفاده از اصول استنباط معصومین علیهم‌السلام در مسائل و حوادث پیش رو به دنبال تحقق تمدنی توحیدی و آماده‌سازی جهان برای ظهور است. رعایت عدالت، معاد باوری، هماهنگی گزاره‌های علمی با ارزش‌های الهی، نگاه عارفانه در سبک زندگی در کنار تکلیف محور بودن رفتارهای انسان و در مقابل تقابل با تمدن استکباری و استضعافی از مباحث بنیادی در فقه تمدن شیعه می‌باشد. نتایج به‌دست‌آمده، حاکی از آن است که فقه کلان نگر شیعه، ظرفیت و بستر تنظیم ساختار جامعه برای نظام‌های تمدنی- توحیدی را داراست و با مدیریت معصوم محور، تنها مسیر درست و عادلانه برای نظام سازی در حوزه مولفه‌های تمدن (اقتصاد، سیاست، فرهنگ، جامعه، حقوق، خانواده و ...) می‌باشد.

this article examines the conceptualization and general and specific capacities of shia civilizational jurisprudence to systematize monotheism based on islamic findings, using a civilizational (genealogical) approach. the paper is written with the analytical-descriptive method. after defining key terms, this study examines the achievements of systematization within civilizational jurisprudence. it then investigates the influence of shia jurisprudence on science, specifically its role in authenticating scientific production, distribution, accumulation, methodology, purpose, and monotheistic applications. shia civilizational jurisprudence, drawing upon revelation, reason, and the principles of infallible inference, seeks to establish a monotheistic civilization and prepare the world for the emergence.  its core tenets include justice, belief in resurrection, the integration of science and divine values, a mystical lifestyle, and ethical human behavior, all in contrast to what it views as arrogant and deficient civilizations. the results indicate that macro-view shia jurisprudence can regulate societal structures for monotheistic civilizations. innocent-oriented management offers the only just and equitable way to systematize all civilizational components (e.g., economy, politics, culture, society, law, family).
