Abstract
digital transformation in international trade, particularly with the emergence of blockchain technology and smart contracts, has raised fundamental questions about the adaptability of these technologies to traditional institutions of trade law, including letters of credit. letters of credit, which operate based on the uniform customs and practice for documentary credits (ucp 600), are founded on principles such as the independence of the bank s obligation, the abstraction of documents from the underlying contract, and the necessity of strict compliance of documents—principles that, at first glance, appear to conflict with the self-executing logic and inherent transparency of smart contracts. this research, employing an analytical-comparative approach, examines the position of blockchain and smart contracts within the structure of letters of credit in the legal systems of iran, the european union, and the united states of america, and evaluates their compatibility with ucp 600. the findings indicate that although ucp 600 is inherently based on traditional documents, it possesses the necessary interpretive capacity for limited adaptation to blockchain technology through tools such as eucp and the acceptance of electronic documents. in u.s. law, recent amendments to the uniform commercial code have provided a clearer legal framework for digital letters of credit, while the european union has adopted a cautious and gradual approach to accepting electronic transferable documents, and iranian law lacks specific regulations governing this transformation. in light of international arbitration practice, arbitration as a flexible mechanism is capable of resolving disputes arising from blockchain-based letters of credit, although challenges such as the evaluation of digital evidence and the determination of the governing law remain persistent. the conclusion is that blockchain and smart contracts, while possessing the potential to enhance the efficiency and security of letters of credit, require gradual revisions to international regulations and the harmonization of domestic legal systems with technological developments.
