چکیده    با گسترش برون‌سپاری در صنایع مختلف و افزایش نیاز به شفافیت، اعتماد و کارایی در تعاملات میان سازمان‌ها، استفاده از فناوری‌های نوین مانند زنجیره بلوکی و قراردادهای هوشمند اهمیت یافته است. قراردادهای الکترونیک مبتنی بر زنجیره بلوکی امکان ثبت تراکنش‌ها به‌صورت تغییرناپذیر، اجرای خودکار تعهدات و افزایش شفافیت و قابلیت ردیابی را فراهم می‌کنند که می‌تواند مشکلات رایج برون‌سپاری مانند تاخیر در پرداخت‌ها، اختلاف در تفسیر شروط قرارداد، نیاز به نظارت دقیق و حضور واسطه‌های متعدد را کاهش دهد. با وجود این مزایا، بررسی ادبیات پژوهشی نشان می‌دهد که کاربرد عملی این فناوری هنوز محدود به پروژه‌های مفهومی و مقیاس کوچک است و موانعی مانند مقیاس‌پذیری، پیچیدگی فنی، هزینه‌های اولیه، فقدان چارچوب‌های قانونی استاندارد و دشواری هماهنگی با سیستم‌های موجود وجود دارد. مطالعات موردی نزدیک به حوزه برون‌سپاری، از جمله پروژه‌های تهیه و تامین منابع و مدیریت زنجیره تامین، نشان داده‌اند که قراردادهای هوشمند می‌توانند تضمین داده‌ها، کاهش اختلافات، بهبود سرعت پردازش تراکنش‌ها و افزایش اعتماد میان طرفین را فراهم کنند. از سوی دیگر، چالش‌های حقوقی شامل پذیرش قانونی امضاهای دیجیتال، صلاحیت قضایی، اعتبار حقوقی قراردادهای مبتنی بر کد و حل اختلافات بین‌المللی همچنان برجسته است. با توجه به این یافته‌ها، طراحی دقیق شاخص‌های عملکرد، فراهم‌سازی چارچوب‌های قانونی و استانداردهای فنی، آموزش کارکنان و توسعه زیرساخت‌ها ضروری است. مسیرهای پژوهشی آینده باید بر مطالعات موردی بین‌المللی، تحلیل تطبیقی قوانین، ارزیابی سودمندی و هزینه، توسعه شاخص‌های عملکرد و مدیریت ریسک‌های امنیتی و مدیریتی تمرکز کنند تا استفاده موثر و پایدار از قراردادهای هوشمند مبتنی بر زنجیره بلوکی در برون‌سپاری امکان‌پذیر شود و ظرفیت‌های این فناوری به‌طور کامل بهره‌برداری گردد.

Abstract    with the expansion of outsourcing across various industries and the increasing need for transparency, trust, and efficiency in inter-organizational interactions, the adoption of emerging technologies such as blockchain and smart contracts has gained significant importance. blockchain-based electronic contracts enable immutable recording of transactions, automatic execution of obligations, and enhanced transparency and traceability, which can mitigate common outsourcing challenges such as payment delays, disputes over contract terms, the need for close supervision, and reliance on multiple intermediaries. despite these advantages, the literature indicates that practical applications of this technology remain largely limited to conceptual and small-scale projects, facing obstacles such as scalability, technical complexity, initial costs, lack of standardized legal frameworks, and difficulties in integration with existing systems. case studies close to the outsourcing context, including procurement and supply chain management projects, have shown that smart contracts can ensure data integrity, reduce disputes, improve transaction processing speed, and increase trust between parties. on the other hand, legal challenges—including the recognition of digital signatures, judicial authority, legal validity of code-based contracts, and international dispute resolution—remain prominent. given these findings, careful design of performance indicators, provision of legal frameworks and technical standards, staff training, and infrastructure development are essential. future research should focus on international case studies, comparative legal analyses, cost-benefit assessment, development of performance indicators, and management of security and operational risks to enable effective and sustainable use of blockchain-based smart contracts in outsourcing and to fully leverage the potential of this technology.
