ظهور هوش مصنوعی به عنوان یک فناوری تحول‌آفرین، نظام سنتی ثبت اختراع را با چالش‌های بنیادین و در عین حال با فرصت‌های بی‌سابقه‌ای مواجه ساخته است. این مقاله به بررسی دوجانبه این اثرگذاری می‌پردازد؛ نخست نقش هوش مصنوعی به عنوان یک ابزار قدرتمند برای افزایش کارایی و دقت در فرآیندهای مدیریت اختراع؛ و دوم نقش آن به عنوان یک مخترع مستقل که مفاهیم حقوقی کلیدی مانند مخترع و غیربدیهی بودن[1] را به چالش می‌کشد. این مقاله استدلال می‌کند که نظام‌های مالکیت فکری در سراسر جهان نیازمند بازنگری اساسی در قوانین و رویه‌های خود برای همگامی با سرعت نوآوری هستند. در نهایت، راهکارهایی از جمله به‌روزرسانی چارچوب‌های قانونی، توسعه ابزارهای نظارتی مبتنی بر هوش مصنوعی و تغییر نقش متخصصان این حوزه ارائه می‌شود.

the role of artificial intelligence in the patent system

the emergence of ai as a disruptive technology has presented the traditional patent system with fundamental challenges and, at the same time, unprecedented opportunities. this article examines this impact from two perspectives using a descriptive-analytical research method: first, the role of ai as a “powerful tool” to increase the efficiency and accuracy of patent administration processes; and second, its role as an “independent inventor” that challenges key legal concepts such as “inventor” and “non-obviousness.” the article argues that intellectual property systems around the world need to fundamentally rethink their laws and procedures to keep pace with the pace of innovation. finally, solutions are proposed, including updating legal frameworks, developing ai-based regulatory tools, and changing the role of professionals in this field.
