تحلیل نقش حقوق بین‌الملل در توسعه اقتصاد دریاپایه با تاکید بر حمل‌ و نقل دریایی

مقدمه:اقتصاد دریاپایه به‌عنوان یکی از مولفه‌های نوین توسعه پایدار، نقش فزاینده‌ای در تجارت بین‌المللی، امنیت اقتصادی و حمل‌ونقل جهانی ایفا می‌کند. در این میان، حمل‌ونقل دریایی ستون فقرات اقتصاد دریاپایه بوده و فعالیت آن به‌شدت تحت تاثیر قواعد و رژیم‌های حقوق بین‌الملل قرار دارد. با توجه به گسترش فعالیت‌های دریامحور و افزایش چالش‌های زیست‌محیطی، ایمنی و حاکمیتی، بررسی نقش حقوق بین‌الملل در تنظیم و توسعه این حوزه ضرورتی انکارناپذیر یافته است.روش تحقیق:پژوهش حاضر به روش توصیفی–تحلیلی و با استفاده از منابع کتابخانه‌ای، اسناد حقوقی و معاهدات بین‌المللی انجام شده است. داده‌ها از طریق مطالعه کنوانسیون‌های بین‌المللی مرتبط با حقوق دریاها و حمل‌ونقل دریایی، رویه‌های بین‌المللی و نظریات دکترین حقوقی گردآوری و تحلیل شده‌اند.یافته‌ها:یافته‌های پژوهش نشان می‌دهد که اسناد حقوق بین‌الملل، به‌ویژه کنوانسیون 1982 حقوق دریاها، مقررات سازمان بین‌المللی دریانوردی imo و معاهدات مرتبط با ایمنی و حفاظت از محیط‌زیست دریایی، چارچوبی نسبتاً منسجم برای تنظیم حمل‌ونقل دریایی و حمایت از توسعه اقتصاد دریاپایه فراهم کرده‌اند. با این حال، چالش‌هایی نظیر تعارض منافع دولت‌ها، اجرای نابرابر تعهدات و خلاهای نظارتی، کارآمدی این چارچوب‌ها را با محدودیت مواجه ساخته است.نتیجه‌گیری:نتیجه پژوهش بیانگر آن است که تحقق توسعه پایدار اقتصاد دریاپایه مستلزم تقویت اجرای قواعد حقوق بین‌الملل، هماهنگی بیشتر میان رژیم‌های حقوقی دریایی و توجه ویژه به نقش حمل‌ونقل دریایی به‌عنوان پیشران اصلی این اقتصاد است. بازنگری و به‌روزرسانی سازوکارهای حقوقی بین‌المللی می‌تواند بستر مناسبی برای توسعه متوازن و پایدار اقتصاد دریاپایه فراهم آورد.

analyzing the role of international law in the development of the blue economy with emphasis on maritime transport

introduction:the blue economy, as one of the emerging components of sustainable development, plays an increasingly significant role in international trade, economic security, and global transportation. maritime transport constitutes the backbone of the blue economy, and its functioning is heavily influenced by the rules and regimes of international law. in light of the expansion of marine-based activities and the growing environmental, safety, and governance challenges, examining the role of international law in regulating and developing this sector has become an undeniable necessity.research method:this study adopts a descriptive–analytical approach and relies on library-based sources, legal documents, and international treaties. data were collected and analyzed through the examination of relevant international conventions governing the law of the sea and maritime transport, international practices, and doctrinal legal perspectives.findings:the findings indicate that instruments of international law—particularly the 1982 united nations convention on the law of the sea (unclos), regulations of the international maritime organization (imo), and treaties concerning maritime safety and marine environmental protection—have provided a relatively coherent framework for regulating maritime transport and supporting the development of the blue economy. nevertheless, challenges such as conflicts of interest among states, uneven implementation of obligations, and existing regulatory and supervisory gaps have constrained the effectiveness of these frameworks.conclusion:the study concludes that achieving sustainable development of the blue economy requires strengthening the implementation of international legal rules, enhancing coordination among maritime legal regimes, and paying particular attention to the role of maritime transport as the principal driver of this economic sector. revising and updating international legal mechanisms can create an appropriate foundation for the balanced and sustainable development of the blue economy.
