چارچوب حقوقی توسعه اقتصاد زیستی چرخشی دریاپایه در ایران

اقتصاد زیستی چرخشی دریاپایه به‌عنوان یکی از شاخه‌های نوین، بر بهره‌برداری پایدار و بازچرخانی منابع زیستی دریایی با هدف ایجاد ارزش افزوده، حفظ تنوع زیستی و کاهش ضایعات زیست‌محیطی تمرکز دارد. این مفهوم در کشورهای توسعه‌یافته، از جمله اتحادیه اروپا و نروژ، به‌عنوان رکن اصلی گذار به اقتصاد سبز دریایی تلقی می‌شود. در ایران، با وجود ظرفیت‌های عظیم زیستی در خلیج فارس، دریای عمان و سواحل مکران، هنوز چارچوب حقوقی منسجم برای حمایت از اقتصاد زیستی چرخشی دریاپایه وجود ندارد. این پژوهش با روش توصیفی–تحلیلی، به بررسی جایگاه مفاهیم اقتصاد زیستی و اقتصاد چرخشی در نظام حقوقی ایران می‌پردازد و خلاهای قانونی در حوزه مالکیت فکری منابع ژنتیکی دریایی، مسئولیت زیست‌محیطی بهره‌برداران، و سیاست‌های حمایتی دولت را شناسایی می‌کند.در پایان، پیشنهاد می‌شود قانون خاص «توسعه اقتصاد زیستی چرخشی دریاپایه» تدوین گردد تا ضمن تضمین بهره‌برداری پایدار، زمینه‌ی رشد نوآوری‌های زیستی، ایجاد اشتغال ساحلی و تحقق اهداف توسعه پایدار دریایی فراهم شود.

legal framework for the development of a circular blue bioeconomy in iran

the circular blue bioeconomy, as an emerging branch of the blue economy, focuses on sustainable utilization and recycling of marine biological resources to generate added value, conserve biodiversity, and reduce environmental waste. this approach is considered a key pillar for transitioning to a green marine economy and promoting bio-innovation in developed regions such as the european union and norway. in iran, despite significant biological capacities in the persian gulf, the sea of oman, and the makran coasts, there is still no comprehensive legal framework supporting the circular blue bioeconomy. this study, using a descriptive–analytical method, examines the position of bioeconomy and circular economy concepts within iran’s legal system and identifies existing legal gaps in intellectual property rights of marine genetic resources, environmental responsibilities of resource users, and government support policies. finally, it is recommended to enact a specific “circular blue bioeconomy development law” to ensure sustainable utilization of marine resources, foster bio-innovation, create coastal employment, and achieve marine sustainable development goals.
