چکیده
|
محیط زیست دریایی بهعنوان یکی از حیاتیترین مولفههای زیست انسانی و توسعه پایدار، در دهههای اخیر با تهدیدهای فزایندهای ناشی از فعالیتهای انسانی، بهویژه جرایم زیستمحیطی دریایی، مواجه شده است. این مقاله با تمرکز بر پیوند میان حقوق دریاها، جرایم زیستمحیطی دریایی، حقوق بشر و عدالت زیستمحیطی، به بررسی چارچوبهای حقوقی بینالمللی ناظر بر پیشگیری، کنترل و پاسخ کیفری به این جرایم میپردازد. هدف اصلی پژوهش، تحلیل میزان کارآمدی کنوانسیون حقوق دریاها و اسناد مکمل آن، بهویژه در حوزه آلودگی ناشی از فعالیت های انسان و جرایم سازمانیافته دریایی، و ارزیابی پیامدهای این جرایم بر حقوق بنیادین انسان و جوامع آسیبپذیر است. روش تحقیق مقاله توصیفی–تحلیلی بوده و با بهرهگیری از منابع اسنادی، معاهدات بینالمللی، رویههای سازمانهای بینالمللی و ادبیات جرمشناسی سبز انجام شده است. یافتهها نشان میدهد که اگرچه کنوانسیون حقوق دریاها و اسناد مرتبط، چارچوبی نسبتاً جامع برای حفاظت از محیط زیست دریایی فراهم کردهاند، اما خلاهای اجرایی، ضعف هماهنگی بینالمللی و ناکارآمدی پاسخهای کیفری، مانع تحقق حفاظت موثر شده است. جرایم زیستمحیطی دریایی تاثیر نامتناسبی بر کشورهای در حال توسعه و گروههای حاشیهنشین دارند و از این منظر، توجه به عدالت زیستمحیطی و رویکردهای حقوق بشری در سیاستگذاری کیفری دریایی ضروری است. در نهایت، پژوهش بر ضرورت اتخاذ رویکردی یکپارچه و چندسطحی برای مقابله با جرایم زیستمحیطی دریایی تاکید میکند.

Abstract
|
the marine environment, as one of the most vital components of human life and sustainable development, has faced increasing threats in recent decades due to human activities, particularly marine environmental crimes. this article focuses on the interrelationship between the law of the sea, marine environmental crimes, human rights, and environmental justice, and examines the international legal frameworks governing the prevention, control, and criminal response to such crimes. the main objective of the study is to analyze the effectiveness of the united nations convention on the law of the sea and its supplementary instruments, especially with regard to pollution resulting from human activities and organized maritime crimes, as well as to assess the impacts of these crimes on fundamental human rights and vulnerable communities.the research adopts a descriptive–analytical method and draws upon documentary sources, international treaties, the practices of international organizations, and the literature of green criminology. the findings indicate that although the convention on the law of the sea and related instruments provide a relatively comprehensive framework for the protection of the marine environment, enforcement gaps, weak international coordination, and ineffective criminal responses have undermined effective protection. moreover, marine environmental crimes have a disproportionate impact on developing countries and marginalized groups, highlighting the necessity of incorporating environmental justice and human rights–based approaches into maritime criminal policy. ultimately, the study emphasizes the need for an integrated and multi-level approach to effectively address marine environmental crimes.
