   واکاوی مسئولیت مدنی ناشی از آلودگی نفتی در محیط زیست دریایی

چکیده    با توجه به حجم قابل توجهی از حمل و نقل مواد نفتی از طریق دریا و وابستگی قریب به اتفاق اکثر کشتی‌ها به نفت به‌عنوان سوخت، احتمال وقوع نشت نفت و بروز خسارات به منابع زیست‌محیطی و محیط دریایی بسیار بالاست. این امر، ضرورت تدوین معاهدات بین‌المللی در حوزه پیشگیری از آلودگی نفتی و تعیین مسئولیت‌های ناشی از آن را بیش از پیش آشکار می‌سازد. کنوانسیون‌های مذکور، با اتخاذ رویکرد مسئولیت مطلق، مسئولیت مدنی ناشی از آلودگی نفتی را به‌طور مستقیم بر عهده مالک کشتی می‌گذارند. بر اساس این رویکرد، تقصیر مالک ضمنی فرض شده و او ملزم به جبران خسارات وارد شده می‌گردد. استثنای این قاعده، شرایط بروز قوه قاهره یا عدم تقصیر مالک است که در این موارد، می‌توان او را از مسئولیت معاف دانست. کنوانسیون‌ها، در عین حال، به مالکان کشتی اجازه می‌دهند تا مسئولیت خود را تا سقف مشخصی که مستقیماً به ظرفیت کشتی مرتبط است، محدود کنند. همچنین، آن‌ها را ملزم به بیمه کردن مسئولیت خود یا ارائه تضمین مالی می‌کنند. این امر، امکان طرح مستقیم دعوی مطالبه خسارت را برای آسیب‌دیدگان علیه شرکت بیمه یا سایر تضمین‌دهندگان فراهم می‌سازد. هدف نهایی در تدوین این معاهدات، تضمین جبران کامل خسارات و عدم رها شدن هیچ‌گونه آسیب به منابع زیست‌محیطی است.

   an inquiry into civil liability arising from oil pollution in the marine environment

Abstract    given the significant volume of oil transportation by sea and the near universal dependence of most vessels on oil as fuel, the risk of oil spills and the resulting damage to environmental resources and the marine environment is extremely high. this situation highlights the growing necessity for the formulation of international conventions aimed at preventing oil pollution and determining the liabilities arising therefrom. these conventions, by adopting a strict liability approach, place civil liability for oil pollution directly upon the shipowner. under this approach, the fault of the owner is presumed, and he or she is obliged to compensate for the damage caused. an exception to this rule arises in cases of force majeure or the absence of fault on the part of the shipowner, in which circumstances the owner may be exempted from liability. at the same time, the conventions allow shipowners to limit their liability up to a specified amount directly linked to the vessel’s tonnage. they also require shipowners to insure their liability or provide other forms of financial security, thereby enabling victims to bring direct claims for compensation against the insurer or other guarantors. the ultimate objective of these treaties is to ensure full compensation for damages and to prevent any harm to environmental resources from remaining uncompensated.
