climate change and the law of the sea: from territorial dividing lines to environmental red lines

Authors
Abstract    the climate change crisis has placed the foundations of the law of the sea under unprecedented strain. the united nations convention on the law of the sea (unclos), built on the principles of geographical stability and territorial sovereignty, faces an efficacy crisis when confronted with fluid and transboundary phenomena such as sea-level rise and ocean acidification. using an analytical-descriptive method, this article demonstrates that conventional solutions based on the broad interpretation of the convention or regional cooperation are unable to provide an integrated, equitable, and timely response to a global crisis, due to the fragmented and static nature of the existing legal regime. examining the challenges of determining baselines, establishing effective marine protected areas (mpas), and the contradictions arising from geoengineering technologies, reveals the necessity of rethinking the paradigm governing ocean governance. consequently, this article proposes that the international community must initiate a serious dialogue to develop an ancillary framework under unclos, based on dynamic environmental principles.
