چکیده    احاله یا تعارض منفی قوانین یکی از مهم ترین مباحث حقوق بین الملل خصوصی است. برخی در مخالفت با احاله آن را دخالت قانون گذار خارجی با حاکمیت قانون در عرصه حقوق داخلی کشورها می دانند، برخی دیگر پذیرش تعارض منفی قوانین را ایجادگر مسئله دور و تسلسل در اجرای قوانین خارجی و داخلی و نوعی تنیس بین المللی قوانین قلمداد نموده اند. اما، به زعم موافقان با احاله، هماهنگی میان نظام حقوقی کشورها در گرو پذیرش تعارض منفی قوانین در حقوق بین الملل خصوصی می باشد.احاله در حقوق بین الملل خصوصی کشورهای مختلف جهان جایگاه ویژه ای را به خود اختصاص داده است. احاله درجه اول در حقوق ایران صراحتاًو درجه دوم تلویحاً پذیرفته شده است. اما، در حقوق کشورهای فرانسه، آلمان، اتریش و لهستان، احاله درجه اول و دوم پذیرفته شده است. این در حالی است که در کشورهای یونان و ایتالیا احاله به طور کلی مغایر با حاکمیت حقوق داخلی قلمداد و رد گردیده است.

Abstract    renvoi, or the negative conflict of laws, is one of the most important topics in private international law. some, opposing renvoi, view it as the interference of foreign legislators with the sovereignty of law within the domestic law of countries, while others see accepting the negative conflict of laws as creating the problem of circularity and recursion in the application of foreign and domestic laws, and as a kind of international legal tennis. however, according to proponents of renvoi, coordination among the legal systems of countries depends on accepting the negative conflict of laws in private international law. renvoi holds a special place in the private international law of different countries around the world. first-degree renvoi is explicitly accepted in iranian law, and second-degree renvoi is implicitly accepted. conversely, in the laws of france, germany, austria, and poland, both first and second-degree renvoi are accepted. meanwhile, in greece and italy, renvoi is generally considered contrary to domestic legal sovereignty and has been rejected..
