آب های سرزمینی و مناطق ویژه اقتصادی (eez) به عنوان بخشی حیاتی از اقیانوس ها، نقشی محوری در تجارت بین المللی، امنیت، و بهره برداری از منابع طبیعی ایفا می کنند. با افزایش فعالیت های دریایی، از جمله کشتیرانی، ماهیگیری، اکتشافات منابع انرژی و ارتباطات زیردریایی، نیاز به تعریف دقیق حدود صلاحیت دولت ها، به ویژه صلاحیت کیفری، بیش از پیش احساس می شود. صلاحیت کیفری دولت ها در این مناطق، بیانگر حق و توانایی یک دولت برای اعمال قوانین جزایی خود در قبال جرایمی است که در این فضاها رخ می دهند. این موضوع، یکی از پیچیده ترین و حساس ترین مباحث در حقوق بین الملل دریاها محسوب می شود، زیرا غالباً با اصل آزادی کشتیرانی و حق حاکمیت دولت صاحب پرچم کشتی ها تداخل پیدا می کند. این پژوهش به بررسی ابعاد حقوقی و قلمرو صلاحیت کیفری دولت ساحلی بر اعمال مجرمانه واقع شده در آب های سرزمینی و مناطق ویژه اقتصادی می پردازد. این امر مستلزم تبیین حدود حاکمیت دولت ها بر فضای دریایی مجاور سواحل خود، به ویژه پس از تصویب کنوانسیون حقوق دریاها (unclos)، و تعیین دقیق مرزهای اعمال صلاحیت کیفری آنها در این مناطق است. دولت ها این صلاحیت ها را به منظور تامین امنیت ملی، حفظ نظم عمومی، حمایت از منافع اقتصادی،نظیر بهره برداری از منابع در( eez)، و جلوگیری از آلودگی های زیست محیطی اعمال می کنند. صلاحیت در آب های سرزمینی تقریباً معادل حاکمیت زمینی است، اما در منطقه ویژه اقتصادی، این صلاحیت محدود به اعمال حاکمیتی خاص و حقوق انحصاری اقتصادی است، در حالی که آزادی کشتیرانی بین المللی برای سایر کشورها محفوظ می ماند. هدف اصلی مقاله، تحلیل تطبیقی میزان و نحوه تعادل برقرار کردن میان حاکمیت دولت ساحلی و حقوق بین المللی دریاها در مواجهه با جرایم بین المللی و ملی واقع در این نواحی است.

Abstract
|
territorial waters and exclusive economic zones (eezs), as vital parts of the oceans, play a pivotal role in international trade, security, and the exploitation of natural resources. with the increase in maritime activities – including shipping, fishing, energy resource exploration, and underwater communications – the need for a precise definition of the jurisdiction of governments, particularly criminal jurisdiction, is increasingly felt. the criminal jurisdiction of states in these areas represents the right and ability of a state to enforce its criminal laws regarding crimes that occur within these spaces. this issue is one of the most complex and sensitive in international law of the sea, as it often conflicts with the principle of freedom of navigation and the right of the flag state. this research examines the legal dimensions and scope of the coastal state s criminal jurisdiction over criminal acts occurring in territorial waters and exclusive economic zones. this requires clarifying the limits of states sovereignty over the maritime space adjacent to their coasts, especially after the adoption of the united nations convention on the law of the sea (unclos), and precisely determining the boundaries of their criminal jurisdiction in these areas. states exercise these jurisdictions to ensure national security, maintain public order, protect economic interests – such as resource exploitation in the eez – and prevent environmental pollution. jurisdiction in territorial waters is almost equivalent to terrestrial sovereignty, but in the exclusive economic zone, this jurisdiction is limited to the exercise of specific sovereign rights and exclusive economic rights, while freedom of navigation remains reserved for other countries. the main objective of this paper is to comparatively analyze the extent and manner of balancing the coastal state s sovereignty with international law of the sea in the face of international and national crimes occurring in these areas.
