   ماهیت حقوقی اختیارات دولت ساحلی در منطقه انحصاری اقتصادی براساس کنوانسیون 1982

چکیده    منطقه انحصاری اقتصادی (eez) یکی از مهم‌ترین نوآوری‌های کنوانسیون 1982 حقوق دریاهاست و در نظام حقوق بین‌الملل دریاها جایگاه ویژه‌ای دارد. این منطقه، میان حاکمیت کامل دولت ساحلی و آزادی‌های مطلق دریاهای آزاد قرار گرفته و از طریق یک چارچوب حقوقی متمایز، اختیارات مشخصی را به دولت ساحلی اختصاص می‌دهد. این ویژگی منحصربه‌فرد، ضرورت بررسی دقیق ماهیت حقوقی این اختیارات را افزایش می‌دهد. این پژوهش با هدف تبیین مبانی و محدودیت‌های اختیارات دولت ساحلی در منطقه انحصاری اقتصادی، به تحلیل صلاحیت‌های این دولت در پرتو مقررات کنوانسیون 1982 می‌پردازد. روش پژوهش توصیفی-تحلیلی است و بر پایه مطالعه مستندات کنوانسیون حقوق دریاها، اسناد حقوق بین‌الملل، دیدگاه‌های دکترین حقوقی و رویه‌های قضایی بین‌المللی اجرا شده است. در این چارچوب، اختیارات دولت ساحلی در زمینه بهره‌برداری از منابع زنده و غیرزنده، حفاظت از محیط زیست دریایی، انجام تحقیقات علمی دریایی و اعمال صلاحیت‌های تقنینی و اجرایی مورد بررسی قرار گرفته است. یافته‌های پژوهش نشان می‌دهد که کنوانسیون 1982 برای منطقه انحصاری اقتصادی چارچوبی حقوقی مستقل و متمایز پیش‌بینی کرده است. اختیارات دولت ساحلی در این منطقه بر اساس اهداف مشخصی مانند بهره‌برداری از منابع طبیعی و حفاظت از محیط زیست دریایی تعریف شده و از مفهوم سنتی حاکمیت مستقل است. بنابراین، تحلیل صحیح این اختیارات مستلزم پذیرش ماهیت ویژه و مستقل منطقه انحصاری اقتصادی در نظام حقوق بین‌الملل دریاهاست.

   the legal nature of coastal state powers in the exclusive economic zone based on the 1982 convention

Abstract    the exclusive economic zone (eez) is one of the most significant innovations of the 1982 convention on the law of the sea (unclos) and holds a special position in the international law of the sea. this zone lies between the full sovereignty of the coastal state and the absolute freedoms of the high seas, granting specific powers to the coastal state through a distinct legal framework. this unique characteristic necessitates a precise examination of the legal nature of these powers. the objective of this research is to elucidate the foundations and limitations of the coastal state’s powers within the eez by analyzing its competencies in light of the provisions of unclos 1982. the research methodology employed is descriptive-analytical, based on the study of unclos documents, international law instruments, scholarly doctrinal views, and international judicial precedents. within this framework, the coastal state’s powers regarding the exploration and exploitation of living and non-living resources, protection of the marine environment, marine scientific research, and the exercise of prescriptive and enforcement jurisdiction have been examined. the findings indicate that unclos 1982 has provided an independent and distinct legal framework for the eez. the powers of the coastal state in this zone are defined based on specific objectives, such as the utilization of natural resources and the protection of the marine environment, and are distinct from the traditional concept of sovereignty. therefore, a correct analysis of these powers requires the acceptance of the special and independent nature of the eez within the international law of the sea system.
