   تحلیل مبنایی ادله اثبات دعوا در حقوق دریایی ایران و حقوق بین‌الملل

چکیده    اثبات دعاوی در حوزه حقوق دریایی و دریانوردی، به دلیل ماهیت خاص و فرامرزی فعالیت‌های دریایی، همواره چالش‌های نظری و عملی قابل توجهی را به همراه داشته است. این مقاله با هدف تحلیل مبنایی ادله اثبات دعوا در حقوق دریایی ایران و مقایسه تطبیقی آن با موازین حقوق بین‌الملل (کنوانسیون‌های لاهه، هامبورگ و روتردام)، نگاشته شده است. پژوهش حاضر با رویکردی توصیفی-تحلیلی و با تکیه بر منابع کتابخانه‌ای، به بررسی ادله اثبات در قوانین داخلی ایران شامل قانون دریایی 1343، قانون مدنی، قانون آیین دادرسی مدنی و قانون تجارت الکترونیکی، و همچنین کنوانسیون‌های بین‌المللی مرتبط با موضوع پژوهش می‌پردازد. یافته‌ها نشان می‌دهد که اگرچه اصول کلی ادله اثبات در حقوق ایران حاکم است، اما ماهیت اسناد تجاری دریایی و نیاز به سرعت در رسیدگی، مستلزم پذیرش ادله خاصی نظیر اسناد حمل (بارنامه، سفته دریایی) و شهادت شهود در شرایط خاص است. تحلیل تطبیقی نشان می‌دهد که حقوق بین‌الملل (به ویژه کنوانسیون روتردام) گرایش به استانداردسازی ادله اثبات الکترونیکی و اعتبارسنجی اسناد حمل دیجیتال دارد، امری که در قوانین داخلی ایران نیازمند توسعه بیشتری است. نتیجه‌گیری مقاله بر لزوم به‌روزرسانی قوانین داخلی با رویکرد بین‌المللی جهت افزایش کارایی دادرسی در دعاوی دریایی تاکید دارد.

   a foundational analysis of evidentiary means for the proof of claims in iranian maritime law and international law

Abstract    the proof of claims in the field of maritime law and navigation, due to the particular and transboundary nature of maritime activities, has consistently been accompanied by significant theoretical and practical challenges. this article aims to provide a foundational analysis of evidentiary rules in iranian maritime law and to offer a comparative study with international legal standards, particularly the hague, hamburg, and rotterdam conventions. the present research adopts a descriptive–analytical approach and, relying on library-based sources, examines evidentiary rules in iran’s domestic laws, including the iranian maritime code of 1964, the civil code, the code of civil procedure, and the electronic commerce act, as well as the international conventions relevant to the subject of the study. the findings indicate that although the general principles governing evidence in iranian law are applicable, the nature of maritime commercial documents and the necessity for expeditious dispute resolution require the acceptance of specific forms of evidence, such as transport documents (including bills of lading and sea waybills) and witness testimony under particular circumstances. comparative analysis reveals that international law—especially the rotterdam convention—demonstrates a tendency toward the standardization of electronic evidence and the validation of digital transport documents, an area that requires further development within iran’s domestic legal framework. the article concludes by emphasizing the need to update domestic legislation in line with international approaches in order to enhance the efficiency of adjudication in maritime disputes.
