چکیده    آلودگی‌های دریایی، به‌ویژه آلودگی‌های ناشی از کشتی‌ها و تاسیسات فراساحلی، از پیچیده‌ترین مصادیق جرایم زیست‌محیطی معاصر محسوب می‌شوند که در تقاطع حقوق کیفری، حقوق محیط زیست و حقوق بین‌الملل دریایی قرار دارد. در نظام حقوقی ایران، ماده 688 قانون مجازات اسلامی به‌عنوان قاعده‌ای عام برای مقابله با تهدید علیه بهداشت عمومی و محیط زیست، مبنای اصلی تعقیب کیفری رفتارهای آلاینده تلقی می‌شود. این مقاله با رویکردی تحلیلی–انتقادی و با تاکید بر تحلیل هنجاری، نهادی و کارآمدی ماده 688 را در مواجهه با آلودگی‌های دریایی بررسی کرده و آن را با الزامات کنوانسیون مارپل تطبیق می‌دهد. یافته‌های پژوهش نشان می‌دهد که کلی‌گویی ساختاری، فقدان تخصص فنی، نارسایی ضمانت اجرا و غیبت مسئولیت کیفری اشخاص حقوقی، ماده 688 را به ابزاری ناکافی در این حوزه بدل کرده است. مقاله با بهره‌گیری از تجربه تطبیقی نروژ، در نهایت استدلال می‌کند که تنها راه تحقق پاسخ کیفری موثر، تصویب قانون خاص و جامع جرایم آلودگی دریایی است.

Abstract    marine pollution, particularly pollution originating from ships and offshore installations, constitutes one of the most complex manifestations of contemporary environmental crimes, situated at the intersection of criminal law, environmental law, and international maritime law. within the iranian legal system, article 688 of the islamic penal code, as a general provision aimed at combating threats to public health and the environment, serves as the principal legal basis for the criminal prosecution of polluting activities. adopting an analytical–critical approach with an emphasis on normative, institutional, and functional analysis, this article examines the effectiveness of article 688 in addressing marine pollution and evaluates its conformity with the requirements of the marpol convention. the findings indicate that structural vagueness, lack of technical specialization, inadequacy of enforcement mechanisms, and the absence of corporate criminal liability have rendered article 688 an insufficient legal instrument in this field. drawing on norway’s comparative experience, the article ultimately argues that the only viable means of ensuring an effective criminal response lies in the enactment of a specific and comprehensive legislative framework dedicated to marine pollution offences.
