دریاها و منابع دریایی بهعنوان یکی از مهمترین بسترهای توسعه اقتصادی و زیستمحیطی، نقشی اساسی در آینده توسعه پایدار ایفا میکنند. بهرهبرداری فزاینده از منابع دریایی، بهویژه در حوزههای انرژی، حملونقل و استخراج منابع، ضرورت بازنگری در چارچوبهای حقوقی حاکم بر این حوزه را بیش از پیش آشکار ساخته است. در این میان، عدالت بیننسلی و مفهوم میراث مشترک بشریت بهعنوان دو اصل بنیادین، میتوانند مبنای حکمرانی مسئولانه منابع دریایی قرار گیرند. هدف این پژوهش، تحلیل جایگاه عدالت بیننسلی در حکمرانی منابع دریایی و ارزیابی میزان تحقق آن در چارچوب حقوق دریاها و حقوق اقتصادی است. روش تحقیق در این مقاله توصیفی–تحلیلی بوده و دادهها از طریق مطالعه اسناد حقوقی، منابع کتابخانهای و ادبیات حقوقی داخلی و بینالمللی گردآوری شدهاند. یافتههای پژوهش نشان میدهد که اگرچه عدالت بیننسلی و میراث مشترک بشریت در سطح نظری و هنجاری مورد شناسایی قرار گرفتهاند، اما در سطح اجرایی، بهدلیل غلبه منافع اقتصادی کوتاهمدت، ضعف سازوکارهای الزامآور و محدودیتهای حکمرانی دریایی، تحقق عملی این اصول با چالشهای جدی مواجه است. نتایج تحقیق حاکی از آن است که بدون نهادینهسازی عدالت بیننسلی در فرآیندهای تصمیمگیری، تقویت سازوکارهای نظارتی و بازتعریف نقش حقوق اقتصادی در بهرهبرداری دریایی، دستیابی به حکمرانی پایدار و مسئولانه منابع دریایی امکانپذیر نخواهد بود.

Abstract
|
seas and marine resources, as one of the most important foundations of economic and environmental development, play a fundamental role in the future of sustainable development. the increasing exploitation of marine resources, particularly in the fields of energy, transportation, and resource extraction, has made the need to reconsider the legal frameworks governing this area more evident than ever. in this context, intergenerational justice and the concept of the common heritage of mankind, as two fundamental principles, can serve as the basis for the responsible governance of marine resources. the purpose of this study is to analyze the position of intergenerational justice in the governance of marine resources and to assess the extent of its realization within the framework of the law of the sea and economic law. the research method employed in this article is descriptive–analytical, and the data have been collected through the study of legal instruments, library resources, and domestic and international legal literature. the findings of the research indicate that although intergenerational justice and the common heritage of mankind have been recognized at the theoretical and normative levels, their practical implementation faces serious challenges at the executive level due to the dominance of short-term economic interests, the weakness of binding mechanisms, and limitations in marine governance. the results of the study suggest that without institutionalizing intergenerational justice in decision-making processes, strengthening supervisory mechanisms, and redefining the role of economic law in the exploitation of marine resources, achieving sustainable and responsible governance of marine resources will not be possible.
