ارتباط متقابل و فزاینده میان حقوق بین الملل دریاها و حقوق بشر بیشازپیش در حال دگرگونکردن و جهتدهی به نظام حقوقیای است که کنوانسیون ملل متحد درباره حقوق دریاها ترسیم کرده است. این همگرایی باعث میشود تفسیر و اجرای مقررات دریایی نه فقط بر مبنای قواعد فنی و صلاحیتی، بلکه با در نظر گرفتن کرامت انسان، دادرسی منصفانه و سایر الزامات بنیادین حقوق بشر انجام شود. روندی که بهتدریج در حال تبدیلشدن به یکی از ویژگیهای اصلی نظم حقوق دریایی معاصر است. با ظهور هوش مصنوعی و پیشرفتهای سریع فناوری در صنعت کشتیرانی، ضرورت حفاظت از حقوق بشر در دریا بهطور چشمگیری افزایش یافته است. استفاده روزافزون از سامانههای خودکار، کشتیهای خودران و تحلیل کلان داده ها نه تنها شیوههای سنتی دریانوردی را دگرگون ساخته، بلکه ابعاد تازهای از چالشهای حقوقی، اخلاقی و انسانی را پدید آورده است. با این حال، همچنان چالشهای اساسی و عمیقی در زمینه پایش، پیشگیری و تعقیب نقض حقوق بشر در عرصههای دریایی وجود دارد. بر همین اساس، مقاله حاضر به بررسی این مساله می پردازد که آیا فناوریهای هوش مصنوعی در حوزه ناوبری دریایی موجب تقویت حفاظت از حقوق بشر در دریا میشوند؟ در پاسخ، به روشی توصفی-تحلیل به این مساله پرداخته می شود که فناوریهای هوش مصنوعی قادرند شفافیت بیشتر، ایمنی بالاتر، واکنش سریعتر و ابزارهای کارآمدتری برای پیشگیری از نقضهای حقوق بشر در دریا را فراهم کنند. اما از سوی دیگر، هوش مصنوعی ممکن است به دلیل سوگیریهای الگوریتمی، کاهش نظارت انسانی، خلاهای مسئولیت حقوقی و قدرت فزاینده بازیگران خصوصی در ایجاد یا تشدید خطرات جدید برای حقوق بشر نقش داشته باشند. بنابراین، تحول فناورانه در حوزه دریایی تنها زمانی میتواند به نفع حقوق بشر باشد که همراه با چارچوبهای نظارتی قوی، ملاحظات اخلاقی روشن و سازوکارهای پاسخگویی موثر باشد.

Abstract
|
the growing and increasingly reciprocal interaction between international law of the sea and human rights is reshaping and redefining the legal framework set out by the united nations convention on the law of the sea. this convergence requires that the interpretation and implementation of maritime rules be carried out not only on the basis of technical and jurisdictional norms, but also with due regard to human dignity, fair trial guarantees, and other fundamental human rights obligations—an evolution that is gradually becoming one of the defining features of the contemporary law of the sea. with the emergence of artificial intelligence and the rapid technological advances in the shipping industry, the need to safeguard human rights at sea has expanded significantly. the increasing use of automated systems, autonomous vessels, and big data analytics has not only transformed traditional modes of navigation, but has also generated new dimensions of legal, ethical, and human challenges. nevertheless, major and persistent difficulties continue to exist with respect to monitoring, preventing, and prosecuting human rights violations in maritime domains. against this backdrop, the present article examines whether ai based technologies in the field of maritime navigation enhance the protection of human rights at sea. using a descriptive analytical approach, it argues that ai technologies are capable of providing greater transparency, improved safety, faster response capacity, and more effective tools for preventing human rights abuses at sea. on the other hand, ai may contribute to or exacerbate new risks to human rights due to algorithmic biases, reduced human oversight, gaps in legal responsibility, and the growing influence of private actors. therefore, technological transformation in the maritime sector can serve the interests of human rights only if accompanied by robust regulatory frameworks, clear ethical safeguards, and effective accountability mechanisms.
