چکیده
|
این پژوهش با هدف بررسی سازوکارهای حقوقی و نهادی برای توانمندسازی جوامع محلی در استان هرمزگان و ارائه راهکارهای عملی تدوین شده است. با تکیه بر مفاهیم جامعه شناسی حقوقی (نهادسازی عادلانه و حقوق عرفی) و نظریه های توسعه (آمارتیا سِن و نایال کبیر) در چارچوب روششناسی کیفی-تحلیلی، 25 مصاحبه عمیق با فعالان محلی در قشم، میناب و بندرلنگه انجام شد. نتایج نشان داد که الگویهایی مانند «تعاونی بانوان صیاد قشم» و «طرح گردشگری روستای سلخ» با آموزش حقوقی و بازآفرینی عرف، به افزایش چشمگیر درآمد خانوار منجر شده اند. با این حال، موانعی چون فقدان بسترهای حقوقی پایدار و ضعف آموزش حقوق شهروندی، مانع توسعه پایدار است. راهکارهای پیشنهادی شامل تاسیس «مرکز توانمندسازی حقوقی محلی» و راه اندازی سامانه «عدالت محلی» است. نتیجه گیری تاکید بر لزوم فعالسازی همزمان قانون، فرهنگ و مشارکت برای تحقق توسعه فراگیر دارد.

Abstract
|
this research aims to investigate the legal and institutional mechanisms forempowering local communities in hormozgan province and to propose practicalsolutions. utilizing concepts from the sociology of law )fair institutionalizationand customary law( and development theories )amartya sen and naila kabeer(within a qualitative-analytical framework, 25 in-depth interviews were conductedwith local activists in qeshm, minab, and bandar lengeh. results indicated thatmodels such as the qeshm fishermen women s cooperative and the salakhvillage tourism plan, through legal education and revitalization of customs, haveled to a significant increase in household income. however, obstacles such asthe lack of sustainable legal frameworks and weak civic education hindersustainable development. proposed solutions include the establishment of a.local legal empowerment center and the launch of a local justice system the conclusion emphasizes the necessity of simultaneously activating thetripartite pillars of law, culture, and participation for achieving inclusivedevelopment.
