the energy charter treaty and the prospects for maritime energy transit security: an analysis of opportunities and challenges for iran`s accession

Authors
Abstract    the security of energy transit, particularly through vital maritime routes, constitutes a cornerstone of global economic stability. the energy charter treaty (ect), as the only binding multilateral legal framework in the energy sector, has established comprehensive regulations for energy transit, aiming to ensure its uninterrupted and non-discriminatory flow. using an analytical-descriptive method, this article elucidates the central role of maritime energy transit within the ect`s legal regime and examines the potential implications of iran joining this treaty. the findings indicate that principles such as `non-discrimination,` `prohibition of interruption in energy flow,` and the `commitment to infrastructure enhancement,` as outlined in article 7 of the treaty and its transit protocol, directly impact crucial maritime corridors like the strait of hormuz, the suez canal, and other international straits. for iran, accession to the ect could serve as a legal instrument to guarantee the free passage of its oil tankers through waterways under the sovereignty of other states, attract investment in maritime infrastructure projects (such as lng terminals and subsea pipelines), and strengthen iran`s role as an `energy hub` in the region. however, significant challenges exist, including potential conflicts with domestic laws such as article 44 of the constitution and the law on maximizing the use of domestic capacities, acceptance of the mandatory investor-state dispute settlement mechanism, and long-term commitments arising from the `sunset clause`. this article concludes that, despite the challenges, proactive accession to the ect—particularly with an emphasis on its maritime transit dimensions—could enhance the legal security of iran`s energy projects and transform the country`s geopolitical position into a sustainable economic opportunity. finally, strategic recommendations such as formulating a roadmap for accession, negotiating intelligent reservations concerning domestic laws, and strengthening maritime energy diplomacy are presented.
