تحلیل حقوقی و سیاست‌گذاری توسعه گردشگری سلامت برمبنای اقتصاد دریاپایه

گردشگری سلامت به‌عنوان یکی از بخش‌های رو به رشد اقتصاد جهانی، فرصت قابل توجهی برای توسعه اقتصادی و ارتقای سطح خدمات درمانی کشورها فراهم می‌کند. در ایران، مناطق ساحلی و جزایر با ظرفیت‌های بالقوه خود، می‌توانند نقش موثری در توسعه گردشگری سلامت در چارچوب اقتصاد دریاپایه ایفا کنند. این مقاله با رویکرد تحلیلی وحقوقی به بررسی فرصت‌ها و چالش‌های حقوقی مرتبط با توسعه گردشگری سلامت در مناطق ساحلی ایران می‌پردازد. هدف اصلی، شناسایی موانع قانونی، مقررات محیط زیستی، چارچوب قراردادها، مسئولیت‌های ارائه‌دهندگان خدمات و بیماران بین‌المللی است و ارائه راهکارهایی برای تسهیل توسعه پایدار این صنعت می‌باشد. یافته‌های پژوهش نشان می‌دهد که همگرایی میان قوانین سلامت، مقررات مناطق آزاد و حفاظت محیط زیست دریایی، نقش کلیدی در کاهش ریسک‌های حقوقی و ارتقای کیفیت خدمات دارد. همچنین، ایجاد سازوکارهای بیمه‌ای و قراردادهای استاندارد برای بیماران خارجی، مدیریت ریسک و اعتماد مشتریان را تقویت می‌کند. این مطالعه می‌تواند به تصمیم‌گیرندگان و سرمایه‌گذاران کمک کند تا با رعایت چارچوب‌های قانونی و محیط زیستی، گردشگری سلامت مبتنی بر اقتصاد دریاپایه را به‌صورت پایدار توسعه دهند.

health tourism, as one of the fastest-growing sectors of the global economy, provides significant opportunities for economic development and the improvement of healthcare services in countries. in iran, coastal areas and islands, with their considerable potential, can play an effective role in developing health tourism within the framework of a marine-based economy. this article adopts an analytical and legal approach to examine the opportunities and legal challenges associated with the development of health tourism in iran’s coastal regions. the main objective is to identify legal barriers, environmental regulations, contractual frameworks, and the responsibilities of service providers and international patients, and to propose strategies for facilitating the sustainable development of this industry. the study finds that the convergence of health laws, free zone regulations, and marine environmental protection rules plays a key role in reducing legal risks and improving service quality. additionally, establishing insurance mechanisms and standardized contracts for foreign patients enhances risk management and builds customer trust. this research can assist policymakers and investors in sustainably developing health tourism based on a marine economy while complying with legal and environmental frameworks.
