چکیده    مناطق ویژه اقتصادی دریایی در دهه‌های اخیر به‌عنوان یکی از پیچیده‌ترین قلمروهای حقوق بین‌الملل دریاها مطرح شده‌اند؛ قلمروهایی که نه واجد حاکمیت مطلق دولت ساحلی در حدّ آب‌های سرزمینی‌اند و نه تابع رژیم آزادی‌های گسترده در دریای آزاد. این وضعیت میان‌مرتبه، نوعی «قلمرو شبه‌حاکمیتی» پدید آورده که در آن دولت‌ها برخوردار از مجموعه‌ای از حقوق انحصاری در بهره‌برداری اقتصادی، حفاظت محیط زیست و تنظیم‌گری امنیتی‌اند، بی‌آنکه بتوانند تمامی صلاحیت‌های دولت‌محور را اعمال کنند. پژوهش حاضر با اتکا بر رژیم حقوقی کنوانسیون 1982 حقوق دریاها و رویه‌های ملی دولت‌های ساحلی پیشرو، به بررسی دقیق سه محور بنیادین صلاحیت در مناطق ویژه اقتصادی می‌پردازد: کنترل سرمایه‌گذاری خارجی، امنیت بندری و حفاظت محیط زیست دریایی.در محور نخست، نشان داده می‌شود که کنترل سرمایه‌گذاری خارجی تابع الگویی دو سطحی است: از یک‌سو حقوق انحصاری دولت ساحلی نسبت به اکتشاف و بهره‌برداری از منابع طبیعی و زیرساخت‌های انرژی، و از سوی دیگر محدودیت‌های ناشی از آزادی‌های دریانوردی، رژیم تردد و تعهدات سرمایه‌گذارمحور ناشی از معاهدات دو یا چندجانبه حمایت از سرمایه‌گذاری. یافته‌ها بیانگر آن است که دولت‌ها برای مشروعیت‌بخشی به اعمال صلاحیت باید میان «مصلحت اقتصادی–زیست‌محیطی» و «تعهدات مبتنی بر رفتار منصفانه و غیرتبعیضی» تعادل ایجاد کنند.در حوزه امنیت بندری، تحلیل تطبیقی مقررات و صلاحیت نظارت بر سکوهای فراساحلی و اختیارات کنترلی نسبت به ورود کشتی‌ها نشان می‌دهد که منطقه ویژه اقتصادی واجد یک «حوزه امنیتی کارکردی» است؛ حوزه‌ای که دولت ساحلی می‌تواند اقدامات پیشگیرانه، جمع‌آوری اطلاعات، و محدودسازی عبور کشتی‌های پرخطر را همچون یک محیط نیمه‌حاکمیتی اعمال کند، بدون آنکه حق عبور بی‌ضرر یا ترانزیتی را نقض کند. در محور محیط زیست دریایی، نتایج تحقیق نشان می‌دهد که دولت ساحلی در eez برخوردار از «صلاحیت حفاظتی تقویت‌شده» است؛ به‌گونه‌ای که می‌تواند مقررات سخت‌گیرانه‌تری درباره آلودگی، پسماند، اکتشاف و حفاری اعمال کرده و در صورت نقض، مسئولیت مدنی و اداری برای عامل ایجاد آلودگی در نظر بگیرد. این پژوهش در مجموع، مدل «شبه‌حاکمیت کارکردی» را برای منطقه ویژه اقتصادی پیشنهاد می‌دهد؛ مدلی که قابلیت تبیین تنش‌های میان آزادی‌های دریایی و حقوق انحصاری دولت ساحلی را دارد و می‌تواند چارچوبی روشن برای سیاست‌گذاری اقتصادی زیست‌محیطی دولت‌ها ارائه کند.

   assessment of state jurisdiction over foreign investment control, port security, and marine environmental protection in the exclusive economic zone as a quasisovereign maritime domain

Abstract    maritime exclusive economic zones have, in recent decades, emerged as one of the most complex domains within the international law of the sea—zones that neither confer upon the coastal state the full sovereignty enjoyed in the territorial sea nor allow the broad freedoms that characterize the high seas. this intermediate legal status has generated a form of “quasisovereign zone,” in which coastal states possess a set of exclusive rights in economic exploitation, environmental protection, and security regulation without being able to exercise the complete range of sovereign powers. relying on the legal framework of the 1982 united nations convention on the law of the sea (unclos) and the national practice of leading coastal states, this study conducts an indepth examination of three fundamental spheres of jurisdiction within the exclusive economic zone: control of foreign investment, port and offshore security, and marine environmental protection.in the first sphere, it is demonstrated that control of foreign investment follows a twotiered structure: on the one hand, the coastal state’s exclusive rights over exploration and exploitation of natural resources and energy infrastructure; and on the other hand, the constraints arising from navigational freedoms, transit regimes, and investorcentered obligations embedded in bilateral and multilateral investment treaties. the findings indicate that, for coastal states to legitimize the exercise of jurisdiction, they must strike a balance between “economic–environmental necessity” and “treatybased obligations of fair, equitable, and nondiscriminatory treatment.”in the field of port and offshore security, a comparative analysis of regulatory frameworks and supervisory authority over offshore installations and vessel entry reveals that the exclusive economic zone constitutes a “functional security domain.” within this space, the coastal state may implement preventive measures, gather maritime intelligence, and restrict the passage of highrisk vessels in a manner akin to a semisovereign environment, without infringing upon the rights of innocent passage or transit passage. in the sphere of marine environmental protection, the research demonstrates that the coastal state in the eez enjoys “enhanced protective jurisdiction,” enabling it to impose stricter rules on pollution, waste disposal, exploration, and drilling, and to establish civil or administrative liability for polluters.taken together, the study proposes a model of “functional quasisovereignty” for the exclusive economic zone a model capable of explaining the inherent tensions between maritime freedoms and the coastal state’s exclusive rights, and one that provides a clear framework for environmentally conscious economic policymaking.
